Libertas humiliated on abortion.

    This happened on TV3 last night in a debate on the Lisbon Treaty. Ursula Halligan asked Libertas head honcho, Declan Ganley about his group's stance on abortion vis-a-vis Lisbon. He said they didn't have a stance per se. Unfortunately, they've been handing out the leaflet below to all and sundry. See the 5th point down.

    As anyone with half a brain knows, the anti-abortion clause in the Irish constitution is protected in the EU treaties under "PROTOCOL ON ARTICLE 40.3.3 OF THE CONSTITUTION OF IRELAND".


    This nonsense will be blown out of the water pretty soon by the Referendum Commission. The Alliance for Europe have asked for a ruling:

    They might not have an opinion on abortion, but it is still a fact that Europe can decide on Ireland opinion on it. how is that humiliating to libertas? they are just simply stating a fact. if a yes vote happens.

    The reason it is embarrassing for them is that Ganley stated they didn't have a position, when they in fact do - it's in their leaflet, and Ganley has said it in interviews.

    The reason he pretended not to have one is because Europe does not decide on Ireland's stance on abortion - or that of any other member state, because abortion is not an EU competence ("abortion law is not within the EU's competence" - SPUC UK). Lisbon is therefore irrelevant to EU abortion law.

    Since this issue causes more nervousness in Ireland than elsewhere, we also have a specific Protocol in the Treaties (both existing and post-Lisbon) which states:
    Nothing in the Treaty establishing a Constitution for Europe or in the Treaties or Acts modifying or supplementing it shall affect the application in Ireland of Article 40.3.3 of the Constitution of Ireland.
