Claiming against Damaged Goods

    I recently bought a windsurfing board online from the UK worth EUR700. TNT delivered it to the delivery address I had provided and the person (who was not the authorised signatory that I had given when filling in the order form) signed for it.

    When I opened the package later that day I noticed there was a large chunk taken off the top of the board and it was unuseable.

    I notified the shop and they told me that the person who signed for it should have ticked a 'damaged' box on the POD and this was stated on the confirmation email when we first ordered the item. This would cover us if the goods were damaged.

    The person who signed for the board did not tick this box as they did not know they had to.

    Does anyone know if I have any come back? The board was so well packed I find it hard to believe it was damaged in-transit and could have been damaged before it was packed.

    Also does it matter that the person who signed for the board was not the authorised signatory who we provided to the shop?

    Any help appreciated?
