    Got stopped on the moped today on the way home from work. Sailed through a pedestrian crossing which I didn't even see as being red. I was paying attention to an upcoming junction at the time and I didn't notice the red light. Got stopped, one gard was very angry, I didn't even know what I was stopped for.
    Anyway he said I'd be getting 2 fines and 4 penalty points. :eek: The offences being driving without due care and attention and breaking a red light. When the gard went to check my tax disk it had fallen out of the plastic clip-holder thing so made me look a right fool. I have to produce my license, tax and insurance details in a garda station.
    Is there any difficulty getting a new tax disk?
    My other question is regarding the points on my license. At the moment I have a full car license and a learner permit A1. Will the points just go on the A1 license or both?
    Got a real fright and can't believe I'm being hit with 4 points.

    The points go on your licence. If you clock up 12 points driving any vehicles you get banned from driving them all. I know a lad in Germany who clocked up his last couple of points on a BICYCLE and was banned for 6 months from driving his car!

    I thought there was a thing whereby you couldn't get multiple points for the same act even if it was more than one offence, though you could be fined multiple times. Maybe I picked that up wrong though. Might be worth checking out.

    At the end of the day though.....you did sail through a pediastrian crossing and 4 points on your licence is nothing compared to what could have happened had you hit a kid or something.

    the fact that you didnt even see the red light (if it was red) shows that you were not paying attention

    thus a ticket for driving without due care and attention

    you can only get penalty points for the offence that carries the most pen points - so they're not allowed add them up; just take the biggest one.

    to be fair, running a red light is pretty bad, but sounds like your garda wasn't entitled to issue you with four points.

    issuing multiple fines is allowed

    I presume it's actually "Careless driving" he's doing you with:
    Careless Driving

    Careless driving is a broadly based offence that allows An Garda Síochána scope to include any specific behaviour by drivers that in their opinion constitutes careless driving and therefore a danger to other road users. Careless driving is a serious offence.

    Detections by the Gardai of drivers breaching the law by driving carelessly involve a court hearing.
    In that case it's a mandatory court appearance and 5 points upon conviction. I can't find an offence similar which gives 4 points.

    I saw that when I was looking at the list of offences alright. He didn't say anything about court, he said I was getting done with two two point offences and two fines. "Driving without due care and attention" were the exact words he used.
    Guess I'll have to wait and see:eek:

    Everyone makes mistakes - some more serious than others. You will receive notice in the post of the offences and you can deal with it then. A replacement tax disc requires you to fill a form (RFsomething or other) at your local copshop and send it to the tax office with a couple of euros (15?).

    The main thing is that you didn't hurt yourself or anyone else and might learn from the experience. Don't sweat it.
