    Hello Folks

    Finally got the green light from Bord Pleanala , just reading through all the paperwork and there is one paragraph in it i cant understand.

    "I would also draw attention to Section 34(13) of the Planning and
    Development Act, 2000, which relates as follows: “A person shall not be entitled
    solely by reason of a permission or approval under this section to carry out a
    development.” This subsection makes it clear that the grant of permission does not
    relieve the grantee of the necessity of obtaining any other permits or licences which
    statutes or regulations or common law may necessitate.”

    Can anyone break that down into plain talk for me please.

    Until we know what the proposal is its difficult to explain the first part. In relation to the remainder I think its probably a fairly standard type wording and an example would be a hotel or pub where you would need a license or placing advertising hoardings where you also need an annual license.

    simple example of what this could mean in your case

    suppose the drawings indicate a new wall built on the centreline of the boundary line with your neighbour . just because you have planning permission on foot of this drawing this does not entiltle you to disegard your neighbour and build that wall , partly on his land , without his consent

    you still have to comply with building control regulations - you must lodge a commencement notice giving min 14 days , max 28 days notice of the start of works

    you must comply with waste disposal regulations , health and safety regs . if asbestos is uncovered during the works it must be disposed of - to regulations

    ESB , water board , drainage dept , bord gais will all have requiremments you must comply with

    the wording is a way of saying - there are other consents and requirements you must comply with
