Dodgy Photos

If someone takes a photo/photos of someone who is drunk doing stupid things such as jumping around naked and acting a clown etc...can they put those photos up on a public website such as bebo even if that person does not want them up? And this is not a joke...i'll get pretty annoyed if the said jealous girl does go ahead and puts them up like she says she will...

I'm dealing with a jealous girl who fancies me (borderline obsessed) at this stage and I was out with college in a friends house and we all went mental and I, obviously, got naked...and now there are a few dodgy photos of me asleep in a bed and there is another girl in the bed with me...and well...this fruitloop is threatening to put the photos up...even though it's just me asleep...but, photos don't look pretty etc etc and I have a girlfriend who will not be too happy I imagine.

Oh sh*te that is quite the situation. Is the other girl naked too? And are you clearly passed out in the photos? If you are that may help your defence.

Best thing to do would be to come clean to your gf before she stumbles across them. Bebo don't allow naked photos so report it as soon as they go up and the site will take them down.

while you haven't really got a leg to stand on bebo T+Cs explicity says any nudity photos on your profile will result in your entire account being deleted and myspace are pretty intolerable towards it too.

so if you keep an eye on her profiles on those sites and as soon as they pop up contact bebo and myspace and ask to have them removed chances are they'll b gone in no time

i know thats more damage limitation that prevention but better than nothing (ps: next time make sure theres no stalky , crazy biatches around next you decide to whip out yer little winky )

Tell her that you will initiate legal proceedings and completely cut her off if she posts them. She won't have a clue whether you have a leg to stand on or not.

Bluff her. Threaten her that you will call the police and get her arrested and in serious trouble if she puts them up. You know that the police can't do anything but she doesn't.

Dude u have to strike first. Get naked pictures of her. Or post the ones of you, but with your face covered, implying that she is some kind of dirty skanky tramp.
But yeah. Tell the GF cos if these piccies get out and u have kept it to yourself..... She might have a few tricky questions for u!

Actually, you do have a leg to stand on, its called harrasment and she can be charged with harrasment if she proceeds to publish those photographs to an open website.

Reporting the pictures to bebo nice and quickly is a good option, because of the amount of kids on bebo they really don't mess about, and will come down hard on anything even slightly inappropriate. But I would personally explain the situation to your gf before it comes to that.

In your case, you could argue defamation for the use of the images, but again, very dodgy grounds.

Bottom line, she has every legal right to use the photos. However, as others have stated, Bebo and such won't tolerate such images being posted.

Your best bet still is to talk to/reason with this other person.

Private property does have a relevant impact on the case (does he have a reasonable expectation of privacy in a bedroom?) I would argue that he does.

Defamation - if person A were to take an innocuous picture e.g. someone sleeping drunk but try to portray it as something else that would lower that person in the eyes of right minded people e.g. person cheating on partner than it could be held as defamation. Of course it depends on the facts of each individual case.

I would be wary about giving legal advice on boards.ie though (nothing that I wrote above should be taken as legal advice by the way). Some of the advice given above is quite suspect and doesn't really help the OP. You should always seek professional legal advice (see FLAC.ie for free legal advice) in case of legal doubt.

Other than that, try to sort it out without looking at the legal side of things beforehand.

Just tell the girl you will never even acknowledge her existance again if she goes ahead with this and will make sure that you enlighten all others about here obsessive nature especially any man she shows the least bit of interest in. If she was a friend in the past tell her that you are very disappointed in her and never thought she could stoop to such a level.

Tell your girlfriend about the photos, better that you do before she has the opportunity to see them herself.

If they are posted report them to Bebo etc. and get her account deleted.

wait now you said you were in bed naked then I'd assume that it was in a private residence. mmm not sure though.... I'd go with the get dirt on her and use it as leverage. and if she does post it on bebo I think you can complain to bebo about the said photo

In his kitchen, everyone was pretty wasted and I took my clothes off not caring. It was banter so whatever. Then I went to bed around 10am the following morning because everybody was up all night, and then I woke up shortly after with another person beside me, and then I woke up again further on, and there was a condom on the girls face beside me with milk in it....this is ridiculous....anyway, i remember the weirdo girl running out saying "i took photos etc"...and one of my friends told her not to put them up on bebo cos they look ridiculous. And she said "I don't care, i'm putting them up etc"

Then I log on to bebo last night, and there is a comment saying "photos will be up soon, i pity the fool who has something to hide haha"

She is a nutbag.

I was caught at the fringe of a similar situation about two years ago and there are several legal routes you can take.

IANAL, though. If it's such an important issue to you then professional legal advice is your best recourse.

But all joking aside, can you not contact a solicitor and get legal advice from there. A consultation shouldn't cost you that much considering the potential for embarressment your facing.
