Sky - contract dispute

    Hi,

    Just off the phone after a very frustrating call with sky.
    The facts:
    1. I'm moving house so I want to cancel my sky and they won't let me.
    2. I didn't get free equipment from them when I subscribed 6 months ago as the rented house already had old equipment.
    3. The contract states in black and white that if you terminate the contract within 12 months you must pay for the equipment if you got it for free. But I didn't get any so the 12 months doesn't apply.
    4. Their staff don't know the terms of THEIR contract.
    5. The new house I am moving to doesn't have an Eircom line so no point taking the equipment (which isn't mine anyway) with me.

    A catch 22 if ever there was one!
    Right now the service is still active in an empty house and I am paying for it.
    What should I do? I was thinking of cancelling my credit card so they can't get any more money from me anyway? But they would owe me money as they take it in advance and I'd like to get that back.

    Hmm, not your normal situation.

    Although you took a "second-hand" contract, the minimum term is still 12 months.

    Why couldn't you just take the box with you? Sky woudl put up a new dish at the new house for you.

    You don't need an eircom line to have Sky.

    According to the contract the 12 months limit is to cover their exposure on the equipment and the penalty is the cost of the equipment. In this instance the cost of the equipment is zero.
    I have it here in black and white in front of me. They just tell me that I need to call another number(that's happened 3 times now)

    The box isn't mine, it belongs to the owner of the house I was temporarily renting.

    How do you negotiate with a company whose employees can only work to a formula and whose superiors will not come on the phone? This is costing me money

    Write to Sky , enclose your viewing card (which remains the property of sky), and inform them that you longer wish to subscribe and owe them nothing as you have not had any equipment or installation from them.
    Keep a copy of the letter and send it registered.
    Write to your credit card company inform ing them that you are in dispute with Sky (SSSL) and ask them to refuse any payment requests.
    If Sky still want to chase you for money let them try.
    No court is going to uphold sky's case under these circumstances.
