Contract Question

    My current employeris currently making a number of people redundant and there are rumors going around that most of our department may be outsourced soon which would almost certainly mean I am made redundant.

    I wish to remain in the current industry I am in, It's what I specialize in and what I enjoy doing but my contact states that I am unable to work for another employer in the same field for 12 months after I leave the company.

    My question is if I resign, or am fired I have no problems to adhering to this, but if I get made redundant why should I have to screw my career up for 12 months because of something I had no choice or hand in?

    This is seldom enforced from what I have found.

    I have changed employer in the same industry a number of times. If you are made redundant it negates the contract as you are not leaving your present employer, he is terminating his contract with you.

    Make sure the payoff is big!! :

    Thanks - anybody else have an opinion, I am worried that when I apply for a rival company that they will ask my former company for a reference and thats when the **** will hit the fan so to speak.

    I do not want to bring it up until the redundancy time comes though as it may make them think I have ulterior motives.

    I would say you would have to be a very high up manager for them to care really.

    Whilst I am not a manager, I do supervise a team of people and provide back-up to the manager of the department when he is on vacation etc. But nobody reports to me directly.
