Am I impatient EBAY seller not responding

Won auction for item on Ebay which ended on 21st Jan 08

    http://cgi.ebay.ie/ws/eBayISAPI.dll?ViewItem&rd=1&item=270204687169&ssPageName=STRK:MEWN:IT&ih=017

I paid for the item on the 22nd Jan 08 via paypal and asked for update of when the shipment would take place.

Response on the 29th Jan 08 from Seller indicated that he was due to take delivery of item within the next 2 days.

My reply was that this was ok and would he keep me informed.

Response on the 30th Jan 08 from Seller stated that he would keep me informed regarding shipment.

After hearing nothing from the seller I decided to send another mail on the 10th Feb 08 and again on the 12th Feb 08. I have not received any response at all to either mail. Today I sent another mail asking for update and outlined that I was becoming concerned with the lack of communication.

Should I at this point be thinking of escalating the matter to EBAY. If the seller fails to respond by Monday I feel that I've given him more than enough time to respond. My emails to the seller alone would indicate that I've been patient.

    What do you think ??

PS...theres no Paypal protection on the item but surely I could contact VISA to recall the payment.

I would be pissed off with the seller. Why do you say there is no paypal protection? The seller does not have good feedback either

    Hi
Yes you are completely entitled to report at this stage. The listing does say paypal protected, eitherway you should be ok. I usually find once reported it ll speed seller up, you should at least get a response from them.
    Best of luck

It looks like I've made a mistake in buying from this seller. Upon looking back at his history a bit closer this scenario has come up for other buyers as well. The seller is sellling items that are not in stock.

I'm normally quite careful when making a purchase, this would be the first time I've ever had an issue dealing with EBAY.

I will see if he responds tonight. If not I will escalate to EBAY in the morning.

In the link above it mentions that PayPal protection does not apply to this item. The link when opened on my screen states this but when you open it that message is not there ?????? This seems to be a regular thing on this sellers auctions.

Paypal would seem to indicate that the purchase would be covered automatically. If the seller does not confirm shipment in his next response I will request a full refund which is $ 169.66 usd. Previous unhappy customers have gone down this route.

How does the escalation process work. ???? Does EBAY act in a timely manner. ??

    1. He does state in the listing that the item is not in stock.

    2. Paypal probably will not cover his listings because of his poor feedback

I would contact your credit card company and dispute the charge

The seller by email quoted to me that the item was due in on the 30th / 31st Jan at which point my item would be processed for shipment. I would then receive a tracking number.

At what percentage does the sellers feeback affect paypals cover ???

Should I use the EBay / Paypal dispute channels or go straight to VISA ??

I would raise a dispute in Paypal initially and see what response you get from the seller.

Update..... This morning when I logged on I have finally received a reply from the seller.

    He response was short

" It will be shipping out tomorrow "

It is a response but I felt its very blaise. I have responded in kind with the following message

That being the case I fully expect confirmation of the shipment and a tracking number for the shipment tomorrow. If no communication is received I will be escalating the matter to EBAY. There is no excuse for your lack of communication on this matter. Furthermore its not good practice to be selling items that are obviously not in stock especailly given that fact that previous buyers have had similar issues in the past.

I paid in good faith with no delay and based on your original email the item should have shipped nearly 2 weeks ago.

I await the shipment details but will not put up with any further delays at your end

    What do you reckon ???

Maybe he will get a move on now that escalation to EBAY has been mentioned. The fact the seller responded.... he/she must realise their pissing me off.

    Opinions ??

I thought that selling items you don't have was against eBay rules, regardless of whether you say that in the auction or not. If it is, then report the sale to eBay anyway. Also, if you don't get the tracking info tomorrow, start a Paypal dispute requesting it. If you get nothing by early next week, escalate to a claim. I know it said no Paypal protection was available, but go through the motions anyway. If you get nowhere with it then contact Visa and inquire about a chargeback.

Lo-Behold I just got an email regarding the shipment. Maybe the seller has grew a conscience and got the finger out. It will be interesting to see what arrives and when. The fecker probably posted a brick..... maybe thats a bit cynical.

The shipment mail originates via paypal. I've never see this before ?????

Seller will still be marked down for poor communication.

Sorry its no help but I'm afraid I wouldn't consider buying from any seller who had 41 neutrals and 23 negatives in the past 12 months. Far too high a rate of unsatisfied people to even consider using. I would report him anyway, you can always cancel the claim if the item arrives.

Well, Thankfully the item has arrived and there are no issues with damage or the like. Even so the communication was piss poor and I would not buy buy from this seller again.

A lucky escape on this one I reckon....:):)

Hi, I won an auction for a ps3 on 3/5. I messgaed the seller, but no communiction has been recived, no invoice, no reply's. *note - I havent actually paid for the item yet, As a rule to myself, I dont pay till i get a reply, on most large items.
so should i back out of the sale, and if so, how? Or should give him more time.
I know its early days, but it is a present and if I dont hear back ill have to buy another one sharpish.
    Thought's?

wait for a response - after a few days contact Ebay saying that seller isnt responding and ask for total amount due (incl shipping).

Did the seller state a P&P figure in the auction? If yes, you should pay for the item. There is no rule on ebay that allows a buyer to only pay when they have got comms from the seller!

I have requested invoice. Also the item location is in dublin, and offers a collection. so I said i would collect it, Messaged them to inform, no response, so im not going to pay for it until they confirm I can collect it.
Also its a nice mannerly thing to have some comms when purchase is more than €150.

  • Registered Users, Registered Users 2 Posts: 17,575 ✭✭✭✭A Dub in Glasgo

Collection is different. As a seller, I would only accept cash on collection.

  • Registered Users, Registered Users 2 Posts: 2,990 ✭✭✭Darksaga87

But im sure maintain some of contact, which i am not getting.
