Sketch of original image [copyright question]

    Hey all!

    Just looking for a bit of advice here, Im not well up on the legal side of copyright etc etc, but I just found an image on Flickr which is a photograph of a hand sketch of one of my photographs.

    The user notes in their description that the sketch is based on a photo by 'click_click' but that is all, no link, no real name etc.

    It's a very impressive sketch I must say. But I'm kind of annoyed that a) they didn't ask for and b) its not exactly the best accreditation going.

    Was thinking I would just FlickrMail and ask for a better acknowledgment and link to the original, but is there more of an issue here than that? I guess anyone is free to just go off and sketch something they like, or are they?

    I'd say that since it's not the actual original photo being used, it might be a bit of a grey area. Seems like it's more of an interpretation of your shot, like a band doing a cover of another bands song. Technically it's original, technically it's not. You could probably get away with asking them to link back to the original....

    If your image is marked as Copyright, all rights reserved, then they are very much in breach of copyright.

    You have exclusive rights to say who can "copy" your image (for ANY use).

    Your options - have them remove the image, or seek full credit for the photo.

    Something somewhat similar to read - this is where someone painted a photo by someone else, and then sold it as their work.
