Freedom of Information and CCTV

    I've a question...

    I understood that under the Freedom of Information act any person would be entitled to a copy of CCTV in which they have been recorded. (questions of who pays for the copy aside for a moment)

    We are talking about a private car park (IE a large shopping center c/p) where there is ample CCTV and a security center. I've been advised that they can see my car and me but not the person that hit it. I know what happend as there was a witness but the company are being difficult. I want to me 100% sure of my rights before I put more pressure on.
    The company have advised me that I cant look at it or get a copy and the Garda can come down and look it it but not get a copy.

    Does anyone know for sure? and if can you point me in the direction of that info? I cant find it on their website.

    Probably not the best of forums for this query. i dont think the gardai would be bothered to be honest.

    You would need to check out whether they are obliged to give you the footage. Good questioon

    There was a post similar to this here before where a customer thought
    they were short changed by a shop assistant.

    They could not look at the CCTV footage as it would infringe on the rights of
    other people filimed, but the manager could check the tape ... or something like
    that!

    There's a Legal Discussion (mind, not legal advice) forum but those guys probably come here too.

    I wouldn't be so sure you have that right. For instance, you can be photographed without your consent and without getting to see the images. Maybe that just applies to the press, police and similar though.

    Not sure about you, but I'm pretty certain that the Gardai can take a copy, if not a warrant (or whatever the specific document for seisure of evidence would be) will force the company to hand it over (personally if I were a judge I'd extend the warrent to ALL their tapes just to piss them off and to see what the heck they're hiding, camera in the womens' toilets or something!? It's just a tape FFS so why they're being so obstinate I don't understand.).

    thats true however its the storage medium of your photograph that is regulated.

    If you take a photo of someone on your camera phone for example, and they ask you to delete and you dont. Then you are breaking za law!
