    a weekend away for two people during the off season? Jeez... not only do they want free photography, they're not even willing to put up a decent prize. Makes me think of the time Ted and Dougal went on holiday only to be stuck in a small caravan with torrential rain outside.

    Also, where are the T&C's?

    Yeah I noticed the lack of T&Cs. At this stage I'd give my right arm to get out of dublin though..

    in the greater scheme of things, I couldn't give a fiddlers about the prize.. It's the T&C's and what they intend on doing with the images is what I'd be concerned with.

    In general I would like our properties to be included in the photograph. I do not have a detailed Terms and Conditions as we would not exploit anyones images. If we receive a high quality image I would suspect that the person may be an amateur photographer and we could negotiate if we wanted to use the image in the future. "

    I emailed them and got the T&Cs:


    The winner shall have their photograph on the Irish Landmark Trust website and brochure if applicable. No alternative cash prize will be given. In the event of the advertised competition prize being unavailable the Promoter reserves the right to offer an alternative prize of equal value.

    HOW TO ENTER

    1 You must be over 18 years of age before you apply to enter or else have written parental or guardian consent and you may not be an employee nor a relative of any employee of the Irish Landmark Trust (“the Promoter”).

    1. You may apply (no maximum photographs apply) to the Promoter.

    2. In entering the competition you hereby warrant that the photograph does not contravene any act, statutory instrument nor is it in any other way illegal, defamatory, seditious or blasphemous or an infringement of any copyright, trademark or industrial design and is an original photograph of the entrant.

    3. The competition is open to amateur photographers only being those not deriving any source of income from the submission of photography work and is subject to the terms and conditions set out in this document. Entry into the competition implies acceptance of these rules. On selection of winners the Promoter may request proof of identity which may be either a valid current passport or driving licence or such other proof of identity as the Promoter may in its absolute discretion accept.

    4. You must also be a resident of the Republic of Ireland.

    5. To enter the competition you must submit your entry on or before the close of business on the 25th February 2008. Under no circumstances will entries accepted after this period be considered valid entries for the competition.

    6. Winners will be selected based on the quality of the image, that the image reflects truly and accurately the subject title and also the uniqueness of the photograph.

    7. The judge’s decision in announcing winners is final and shall not be subject to review or protracted correspondence on the matter.

    D I S Q U A L I F I C ATION

    1. The Promoter may disqualify you at any time if the Promoter is of the view that you have not complied fully with the terms and conditions.

    D I S C L A I M E R

    1. Neither the Promoter nor any of its servants or agents shall have any liability whatsoever or howsoever arising directly or indirectly from your participation in the competition or the termination thereof whether by disqualification or otherwise and whether such termination or disqualification was lawful or not.

    2. The Promoter makes no representation, assurance or warranty (and as such is expressly denied and may not be implied) as to the condition or fitness for purpose of the prize.

    WA R R A N T Y

    1. You hereby expressly warrant without any qualification whatsoever that you are physically and mentally capable of partaking in the competition and you hereby covenant and agree that you shall not endanger yourself or others by your participation in the competition and shall in any event fully indemnify hold harms make good any and all losses, damages, claims and expenses (including legal expenses) incurred suffered and sustained by the Promoter or any third party resulting directly or indirectly from your participation in the competition

    RIGHT OF RECORD

    1 By entering into the competition you agree that throughout the entire of the competition and after your participation in the competition is finished (whether by winning it, by retirement, disqualification or otherwise and whether such disqualification was lawful or not), you shall upon request and without payment:

    1. Give interviews to the Promoter, its servants or agents; and

    2. Take part in publicity events and broadcasts relating to the Promoter and the competition including any recorded sound or televised recording as the Promoter shall request.

    3. Ownership in such interviews, events and recordings and the copyright and all moral and intellectual property rights in them shall vest absolutely in the Promoter who may exploit them entirely as the Promoter sees fit.

    4. It is the responsibility of the winners to ensure that any necessary permissions needed to enter the photograph into the competition are obtained.

    PROMOTER’S DECISION IS FINAL

    1. By entering into the competition you accept absolutely irrevocably and without qualification that the decision of the Promoter and all things relating to this competition and file and as participants shall be final, binding and conclusive. There shall be no appeal.

    2. The Promoter may, if it chooses, execute its discretion or make any decision in response to an invitation to broadcast to any party any particular matter, including the disqualification of any entrant.

    G E N E R A L

    1. This document contains the entire of the terms, conditions and rules of the competition, save where otherwise expressly stated herein, and you agree to be bound by them and them alone. You acknowledge confirm and agree that the terms conditions and rules shall prevail over any terms, conditions, representations or statements inconsistent herewith and appearing in any advertisement, sticker, letter, flyer or any other document. Any terms, conditions, representations, statements, warranties or advertisements inconsistent with the terms, conditions and rules set out in this document are expressly excluded and the Promoter is not bound by them.

    2. No waiver by the Promoter of any breach of the terms, conditions and rules shall be considered a waiver of any other breach of such or other term, condition or rule.

    3. If any provision of the rules is held by a competent authority, court or tribunal to be invalid or unenforceable in whole or in part, then the validity of the other provisions of the terms, conditions and rules and the remainder of that provision shall not be affected thereby.

    4. The Promoter hereby reserves the right to amend any of the terms, conditions or rules contained herein at any time without advance or other form of communication to the entrant.

    Ownership of the interviews/events etc? Is thi claiming complete ownership of the photos? Its not is it? I hate legalese..

    I'd imagine that's ownership of any media that arises from your entry into the competition. It doesn't expressly state anywhere in the T&C's that entered images become property of the promoter..

    I suppose what they're at is if you gave a radio interview and took a soundbite of it to put on your own website that technically you should have to get written permission off them first.

    I think you're right. Seems ok so - just covering their arses if you fall down a hole trying to take a shot..

    There's one in Temple Bar - might give it a go. Its a project if nothing else.

    It means what ever you do or have to do afterwards, media wise, is their property and they can use as they see fit. If you give an interview, they can use that in their ads and you can't stop them or get paid.

    They don't own the photo, but can use it on the website and/or brochure. Only the winner though

    Tried the old lighthouse down in Wicklow today, but couldnt figure out to get close enough to it to bother getting a pic (the view from the main road didnt look good enough to bother!) - seems theres a long private road leading to it.
