Issue with Another Flickr User

    Hey Folks,

    I've just noticed that a picture of mine has appeared on another users Flickr page. I had set the rights of the photo so it couldn't be used anywhere else. I sent them a mail and put a comment on the picture.

    Is there anything else I can do to make sure they remove the picture?

    Email flickr - ask them do they know that their site is currently hosting copyright infringing files and issue them with a cease and desist order :D

    Or just email flickr nicely and tell them about it ;)

    (The lawyerly side of me wants to go with option 1 though).

    Ahh I'm not that mean thirdfox. Flickr is a great site, so I'll give the user time to remove it (hopefully) and if that doesn't work then I'll email Flickr themselves and hopefully have it removed.

    Something like that happened to me a while back - some eejit took a photo I'd posted to trekearth.com & posted it as his own on flickr - then added it to a group I contribute to! turns out all of his images were stolen/borrowed/copied from someone else...

    Good to hear that you're not ruthlessly cold :)

    But, just in case you are going down any sort of legal avenue (or may go down one) do save a few copies of the infringement onto your computer (download the full page onto your hard-drive as evidence).

    These sort of things usually end without much confrontation though (s/he'll know s/he's been caught and will probably back down).

    It's always best to just allow your contacts access to larger file sizes as well... or did the user in question just take the standard "medium" flick photo?

    All of my photo's are public and everyone can access the larger files. The user in question downsized the image considerably and uploaded that to their page.

    Actually I think this may all be my fault. I just noticed the image says this 'Any user can download this photo because you've applied a Creative Commons license to it'.

    I have this license on it: Attribution-NonCommercial-NoDerivs Creative Commons.
    Surely though it means they can't use it themselves? Have I got this all wrong?

    Which of the licenses should I be using if I want the pictures to be public but that they can't be used elsewhere?

    Well, did they attribute it to you? Cos if not, they have broken the terms of the licence anyway.

    As a general note I strongly recommend people stay away from the Creative Commons because it has a few trip up s

    Ahh no they didn't attribute it to me. So what license should I have on the pictures? I want people to view them, save them etc but I don't want them appearing anywhere else.

    I think that's a bit harsh, but yes you should take some time to pick the correct license and understand the differences between them.

    Indeed it means that there is no license (for them!) You have kept control of the license solely to yourself and can choose to sell/pass on etc. to anyone of your choice.

    CC takes that unilateral control away and as long as you are credited they can choose to use your image in a variety of ways (subject to your original limitations). There are ways to get around copyright too but it's a damn lot harder to legally do so.

    Our IP (intellectual property rights) law lecturer said that while CC is an interesting and novel idea, it's still in its infancy. That's why all my images are (c) - if someone wants to use it, ask me nicely and I'll probably let them (maybe for a fee, maybe not.)

    See my comment about taking anything of what I said as authoritative legal advice ;) - and unsurprisingly most people don't really know too much about law unless it affects them directly (so play it safe and use copyright!)

    same happened to me, a chick copied a picture I took and plonked it under her own pics. I don't think she realised she was doing wrong because the original pic was actually of her (running in the Cork City Marathon) and she added a comment to my pic saying it was her. Anyway, I browsed her pics in her own collection and noticed a few of my pics there, I just added a comment to each of the pics stating that she should not do that and she apologised and removed them.
