    right i have a question for ye !!!

    if you sell a car sold as seen ; & it turns out theirs something wrong with it ,
    that wasent know at time of selling.
    is the seller obliged by law to refund the moneys paid for the car & take it back ?

    or has the buyer the legal right to return the car & get his money back ?

    If it's sold as seen I'd say your on your own and even a dealer will give you a swift dispatch, I know I would.;)

    Could the fault with the car be considered known at the time by the seller and s/he chose not to say anything?

    if it's sold as seen it is up to the buyer to fully check out the cars mechanics , bodyworks as they have little to no recourse after the sale has been completed

    Did you buy privately or from a dealer? I know it's no help to you now, but I can't for the life of me understand why people buy cars a without full, verified service history. Even if it hadn't been clocked, how can one tell whether it's been serviced?

    From what I can remember, is that if you've bought from a trading company, then you are protected by standard consumer rights, and you have the legal protection to be able to return the car within 7 days (!) and get your money back, regardless of how it was sold, what signs are hanging in the place denying this, etc. However, after that period you will have to prove that the seller WAS aware of the problem and that he willfully did not disclose this to you. And that's going to be very hard in the case of clocking, as the vendor might have bought the vehicle like it, and then it's case closed unfortunately.

    If the seller is a private individual, then you would have no rights whatsoever to return and get your money back, and it would definitely be up to the buyer to have checked everything out beforehand.

    if you bought from a dealer you may have a short warranty period, in the UK its 3 months. Don't know if its the same here.

    If you were to 'find', a major defect you could possibly take it back and force him to fix it, something that requires a new engine perhaps ?

    At the very least you can report the case to the trading standards people and let them investigate.

    With so many private mechanics in the country its no surprise that lots of cars don't have a service history and clocking is probably widespread.

    And I can't for the life of me understand why people don't all buy Bentley Continentals instead of Skodas, or Golfs or whatnot. I mean, they're much nicer... it just doesn't make sense!

    If you're trying to imply that cars with FSH are more expensive than cars without then you've a bit to learn about motoring.;)

    So have I then because if I saw two otherwise identical cars, one with FSH and one without, and the FSH car was cheaper I'd assume that it was dodgy. I have never seen a car with history cheaper than an equivalent car without.

    Now if you mean you can get a 10 yr old Opel with FSH for less than a 2 yr old BM 6 series without then yes, but that's not comparing apples and apples, is it?

    That was more the point - although that example is somewhat extreme. :)

    It always comes up with classics and rust too. People say "don't touch it if there's any rust". Though this is sound advice - some people can't afford a car without rust! Of course one could always wait till you could afford it - but sometimes people only have a small window of time to indulge themselves!

    Of course there is. But when the price of a FSH or of 'no rust' puts a car out of reach, sometimes the heart wins. If it were only about money we'd all be driving Toyota's.

    As for fsh - it is only an aid, or guide to condition, nothing else. If it's maintained by €9/hr monkeys in a €90/hr main dealership, doesn't exactly add anything to the value of the vehicle, nor constitute any kind of warranty......
