Paypal & Chargebacks

    Hi,

    Hopefully somebody can help.

    I bought three items from a seller on ioffer six weeks ago. I received one item. He described the quality as 10/10 and its clearly not. I filed a dispute with Paypal. The seller could not currently respond to the dispute, so I escalated it to a claim. I got the following response from Paypal within 5 minutes:

    "Our investigation into your claim is complete. As stated in our User
    Agreement, the claims process only applies to the shipment of goods. It
    does not apply to complaints about the attributes or quality of goods
    received. Therefore, we are unable to reverse this transaction or issue a
    refund. "

    As I only received 1 out of the 3 items, could I file another claim regarding shipment of goods for the 2 items I haven't received? Or would I be better off asking my credit card company to do a chargeback? What sort of information do I need to provide my credit card company with? Are they reluctant to do chargebacks?

    Were all 3 items paid for at the same time, with one transaction? If so, I don't think you can start another complaint as you've already put one in for that payment. If they're separate then I'm sure you can.

    A chargeback will force Paypal into investigating properly though, rather than the auto response you got the last time. Might be worth doing.

    Yes, I paid for them in one transaction. I'll give the chargeback route a go. Is there any department I need to specifically ask for (fraud ?) or is it just general customer care?

    I think it's just customer service, or choose disputed charges if that's an option.

    Have you contacted the seller about not recieving the items and what did they say?

    The auto response above is because you can not file a Not as Described claim against items that were not bought on eBay.

    The quickest solution usually is to just contact your seller, then if they are unwilling to help give your card company a call.

    Yes, I contacted him, no response. I left another message 4 days later. He then said he'd send them out the next day. That's a week ago. I have my doubts whether he has or will send them out. It took him 3 1/2 weeks to send the first item. The first item was not as described. I told him the problems I had with it and asked him for a refund. He said he doesn't do refunds. He recently got negative feedback for items not received and also lost a paypal claim. Things don't look good. Thanks for your replies.
