a mate of mine was refused leave to travel at dublin airport because of something like that, tho I don't know all the details. As far as I remember, he had to go to the embassy to get a visa, which he did get in the end.

Theres no point in being too honest here , that charge is nothing , dont even mention it , dont put it on the form , you'll have no problems.
Theres no way US customs check the legal history of everyone entering the states , the costs would be way too high ,

So keep it under your hat and enjoy your trip to the states.

Was it recently or long ago. I know someone who got into deep dodo about 20 years ago and said nothing. He is back and forth across the pond now like a yoyo. I do believe that they have access to the irish records computer. When I go across to the states, they do the immigration in dublin and it could take a few minutes to process. They are definately checking something.

"Breach of the peace" is specifically excluded from the list of offences that qualify.

If you answer 'no' to the question on the form that relates to "have you ever been convicted for an offence bla bla bla" you'll be grand

They've arrested and banned people from coming back for 10 years for staying a few days too long on their visa, so lying on the form may be a bad idea.

Since 9/11 there is more fear of being the one that stamps the visa of a terrorist, than pissing off 10,000 innocent people trying to come over on holiday.

Breach of the peace hardly makes you on the FBI most wanted , and the simple fact is that if you answer in the positive on any of those questions on the form , you get turned back and your trip is over .... so lie , if you really want to go.

Never said it did, but lately they've gone completely overboard. Get advice from the American embassy about it, and see what they have to say about it.

    Kenny, dont stress about it.

A friend of mine was charged with Breach of Peace, D&D.

Back and forth between here and the states for two years.

They granted him a visa and now he lives there.

Dont mention it on your Visa waiver - Youll be fine.

The only thing is, that I am bring my Misses with me, and I wouldnt want to be sent back home. I think that would end in me getting my arsed kicked.

I did check it out on the state department website and from what I understood, it said that if you have a commited a crime inwhich you have not served upto 6 months for you'll be ok.
I might just ring them and pay the 16euro for the phone call, yes it 2.40 a min or 16 euro to ring the american embassey.

Honestly, don't risk it, get a Visa.
Friend of mine didn't mention a previous minor conviction on her form in emmigration at Dublin and was refused. Watched her mam and sister head off to the states as well as being highly embarassed and upset. Got her Visa and had no problem this year.
Why let something you can prevent ruin a holiday?

It doesn't work exactly like that, the question on the form is regarding offences involving "moral turpitude" i.e. you need to have demonstrated "evil intent" when commiting the offence.

The US state department maintains a list of offences that apply. If you've commited an offence listed there, you need to go to the embassy and apply for a visa.

"Breach of the peace" is specifically excluded from that list, hence you don't need a visa.

Do you have a copy of this list?
