Hand from last night ,after the river is delt im first 2 act, 4 players in the hand .I check its checked around 2 the button who bets 12 i raise to 40back to the button who not paying attension throws his hand on the table face up and declares his hand which is better than mine .now i presume seeing this he has called and i muck.But it turns out he never said call nor put in the chips . i was in seat 1 he was in seat 10.So has he called my raise or whats the ruling

You're not paying attention either. His pot, you mucked. Although others will clarify what happens to the €28.

In some places it would and OP would get the pot if he had cards. Once he mucks, I can't see how the pot could go to anyone but the button.

I think the fairest decision would be that you get back your €28 uncalled bet and he wins the pot as you mucked your hand. And you both learn a lesson for not paying attention!

i was on dealers left and could not see the other player when he showed his hand the dealer looked at me and said nothing just looked as if to hurry me up thats why i taught he called. i know i lost the pot but the 28?after the hand the dealer said he never called but he still got the money
