My friend was at a mucis event in June and was caught with 10 E Tabs. Name address etc was all checked out and he was let go..wasnt charged or finger printed and has heard nothing since. Has he got away with it? Is there a maximum period as to which a summons needs to be delivered?

I'm guessing since its a music festival and that loads of people would get caught... he probably got away with it. 10 is not a lot compared to the amount some people carry around with them at music festivals. Plus, he wasn't selling them... or was he?

your friend can be summonsed. the guard has 6 months to apply for the summons where at which point it can take several months before it is issued and brought before court...if of course the Guard prosecutes that is.

No it was for himself. So does it sound like a summons should have been sent by now?

The best thing your friend can do is first go to the station of the arresting garda and speak to them. This can go down very well in court. If they throw themselves on the mercy of the garda, the garda can/will speak well of them in court. Which will probably reduce the charge to a 300 quid fine, or maybe just 150.
Garda are incredibly vain, and love it when you kiss their assh*les. As he has probably never been to court (for sh*t and st*ff). The garda speaks and if they say a good word for you,,,, like you came along with a toadying belly crawling apology,,, the judge will ,,, (cough,, cough) swallow it.

The truth is, most of the law society are coked out of their mindshalf the time. The Garda like a good smoke. And only the sorriest b*stard does time for a few pills. ,,,,,,,,,, They were probably crap pills in the first place.

Don't lose sleep over it. Go to the Garda first. If that doesn't work out well, go to a solicitor (get one who wears a bad suit and smells funny. They're usually the best, for getting a brother out of a jam).

The judge and the garda are not bad people. They've just got a job to do. To hand out slaps on the hand to some people and kosh down others. The sooner this sh*t is over, and they can get back to taking quality recreational drugs, the happier we'll all feel. This is, afterall, Ireland,,,,,,,,,The cocaine nation. (Pills are for pikeys. Get yourself some krystal MD)

Don't do a line, if you can't do the time!

You can't get legal advice on this forum, you/your friend should contact a solicitor.

But do not listen to the last poster.

A mate of mine got caught with a small amount of hash at a concert. Cops took his name and details and confirmed them. Nothing happened after that.

If I were him I wouldnt go to the station. As mentioned above, they deal with a lot of stuff at concerts, so I doubt they do anything about anyone with drugs, Unless they are dealing or its a very high quantity

All drug charges for arrests made at a music festival are generally held on the same day, at the same court.

That is if you were at some metal festival and were arrested. You'll be summoneds to appear on the same day and same court as all your metal head friends. I've know people who have been to some of these exclusive functions. And they can kind of be surreal.

Your trial will last at most probably three minutes. Where you'll either recieve a fine, or at worst a suspended sentence.

You don't need a solicitor. But having one may help avoid things going haywire. Like if you did something stupid, like abuse the arresting garda in the process of the arrest. I've known people to get six months, purely based on the aggravation. If you did abuse the garda, try and contact them before the court appearance, and apologise. If the garda reads out a litany of expletives that you employed against, during the course of them doing their business. You could be in serious trouble.

Also, in these cases it's very important to know. That if the garda is nice, it can greatly effect the outcome. But if everyone gets out of the wrong side of the bed on the day,,, work it out yourself.

There's an absolutely massive difference between possesion for personal use and possesion with intent to supply. Ten pills in theory is enough for intent to supply. But the likely hood is on the day of the court appearance, there will be people there who were caught with 50's, maybe a 100. If the first person up, gets just a fine, for possesion of say 50, then breath a sigh of relief. As the benchmark will have been set for the day.
