    Whats the stroy with contracts?

I've been in a job 8 months but havent signed anything.

I was told to day that contracts would be sent out to all staff after chritmas and that my job offer would act as my contract.

    Is this right?

The reason why I'm looking for this is my job discription as I dont have that either.

That's not very professional on the company's behalf - get that sorted ASAP!

Incidentally, in a lot of places, the contract may have your job title but not description. This can often be in a different document altogether. It probably makes it easier for the company as they can have a standard contract for all the staff, and I'd imagine that it's easier to change the job description document than the contract.

I've emailed HR and they siad to go to my boss for a job discription.

What he thinks my job discrption is different to what I had assumed I would be intial employed as so I'm thinking of lookinf for a raise.

I'm also getting pissed off with the demands being placed on me and what to see if any of this was overed in the contract.

As I said, a contract will most likely be pretty vague to allow for slight changes in responsibilities. In fact, a job description may also be pretty vague also for the same reason. What type of job are you in?

    Civil engineer.

I just checked my job offer and it clearly states assitant engineer while my boss continually refers to me as a senior enigneer and have been attending senior engineers meetings since they have started recently.

    Kearnsr,

If you didn't sign a contract on joining the company, then you don't have a contract! A written contract only becomes binding when it has been signed by the employee. Not everyone who is employed has a contract.

However, the company must provide you with a written 'Terms of Employment' within 2 months of starting work (Terms of Employment Information) Acts 1994 and 2001. This must include (amongst other things) job title/nature of work.

You should ask your HR department for a written 'Terms of Employment'.

I've asked them for general job description/contract/duties but was told contract would be after christmas and speak to the boss re duties.

If I dont have a contract signed what kind of notice applies?

In the job offer there is stuff about notice but is that offical?

OK, that's a start - is/he is actually using a specific title, rather than just giving you more work, which could be deemed reasonable in a vague enough description. Try and construct a way to have your boss give you that title in an email.

Email that went around with name changes

    Our Ref: A-1
To: Senior Engineer 1, Senior Engineer 2, Kearnsr

    Date: 29 August 2007

    Re: Infrastructure Division re-organisation

    Dear All,

Following a meeting with Senior Engineer 1, Senior Engineer 2 and Boss on Monday 27 August 2007 the following steps were agreed:-

    1. Senior Engineer 2 is to move into Section 2 and is to take manage the staff in Section 2
    2. Senior Engineer 1 will be managing all staff in Section 1.
    3. kearnsr is to remain in Section 5 for the moment

Senior Engineer 2 will be moving on Friday 31 August. Boss to circulate the staff in Section 1 and 2

    4. A weekly Infrastructure Management Meeting is to be held as follows:-

Every Monday morning at 8.30 AM

This meeting will commence on Monday 3 September 2007 and attendance by the following is obligatory

    Senior Engineer 1

    Senior Engineer 2

    kearnsr

    Boss

Meetings are to last less than half an hour. At the meeting each of Section 1, 2, 5 and Boss are to set out their main objectives for production during the coming week and agree priorities and sharing of resources.

Below is the draft of the e-mail to Staff in Sections 1 and 2 for your information and comment:-

    Dear all

On Monday 3 September 2007 Heinz will be taking over management of Section 2 as the Senior Engineer for the Section.

Senior Engineer 2 will be relocating from Section 1 to the seat beside Senior Caddie.

Senior Engineer 1 will remain in Section 1 and will manage all of the Section 1 work load.

To facilitate this change it would be helpful if each member of Sections 1 and 2 prepare a brief list of their projects and expected work load for the next two weeks for Senior Engineer 1 and Senior Engineer 2 to review on Monday.

Projects will remain split up between Senior Engineer 1 and Senior Engineer 2 as before but the reorganisation will assist in spreading the work load more evenly.

We would all like to congratulate support Senior Engineer 2 on this move and on taking on additional responsibilities in his role as leader in Section 2

    Boss

    Regards,

    Boss

As I said, that's an awful lot better than you just saying that you've been given more work to do.

I'd push for the contract. It should at least have the job title on it. In fact, what you could do is send an email to your boss saying you haven't received your contract as a senior engineer. With any luck he will forward it on to HR, and your contract may then be made out to include that job title.

It's all about what is written down, even by email - not what is said in meetings. Don't let yourself get bounced around between your manager and HR.

Sorry I was trying to say it was implied I was a senior engineer by the attendance of senior engineers meetings rather than what has been said in the meetings.

Yeah, I saw the email you posted after I had written that post. That does make it a bit tougher. I don't think there's much more you can do than just ask your boss if he agrees that you're acting in a Senior Eng. capacity at the moment. If he does, then you're getting somewhere. If he doesn't, then you have a lot more to do in order to fight your corner.

What approach in my email would you suggest?

That's a tough one to answer. It all depends on how you get on with your boss, what career progression is like in your company etc.

I would be inclined to start with an informal chat with your boss, and ask him if he agrees that you are currently acting in a senior engineer's capacity. If he does, and it looks to be permanent role for you, then ask how you go about getting this made official and take it from there.

I just sent him an email asking to confirm my duties to avoid what happened on friday (boss was ringing me on friday on my day off and it really pissed me off) saying that HR advised me to do this as there was a lack of contract/duties on file.

I mention the role as senior engineer i.e what role does a senior engineer have so I'll see what his reply says
