xbox 360 scratching discs

My friend is just after picking up a copy of halo 3 (not the limited edition) and after less then 2 days the disc has become scratched and unusable.

The scratches are circular, and are obviously as a result of the lens or something hitting the disc. It's happened to him before with Rainbow Six Vegas. The Xbox hasn't been moved around at all while playing, and has been lying horizontally for the last year.

Has anyone had this problem before, and if so, who is to blame? Should he go back to Game or the shop he got it, or should it be taken up with Microsoft?

Sometimes a disc that isn't properly balance or a mis-aligned lens. Good on getting a exchange. :(
