planning consultant in Dublin 6?

    The people who recently bought the property behind my parents' house near Ranelagh have built a one storey house about 5 meters high, 5 meters wide and 7 meters long with an A-from roof at the very bottom of the garden.

    So now it dominates the view from my parents' garden and the neighbours' gardens. We wouldn't mind so much if any of this were necessary, but it's not - there's plenty of space to build this thing in a location that wouldn't impinge on us. If they had followed the original planning (which no one objected to) we wouldn't have a problem).

    All the properties involved are protected structures

    They originally had planning permission to build it 20 feet further up their garden. It's supposed to be ancillary accommodation, but now it is so distant from their house, it could be used to put a tenant in or anything. We are worried about it being occupied by noisy teenagers or college-age offspring, because it is so much closer to our house than it is to theirs and we would be effected by the noise, not them. Presumably they will have to build some sort of access road to it as well, although they haven't mentioned that so far.

    After a lot of discussion and architects' reports (which was really just time-wasting on their part) and promises that they would remove the building if necessary, they've now decided to apply for retention. They put an ad in the Irish Independent yesterday.

    My parents and their neighbours don't know what they are going to do.

    The person who has bought this property and is developing this is one of the best known and wealthiest names in the Irish real estate and comes from a famous political family (which he made sure to point out to me during my discussion with him).

    He and his well-known architect say that they have lined up one of the best planning consultants in the business and they are sure they can push this through. We feel these people are just bullies whose word means nothing.

    My parents are just people who happen to live in this house and they feel that they are being trodden upon and don't know what to do.

    Where can we find someone experienced in dealing with this type of situation to help us fight this?

    any planning consultant (or any persone) can make an observation on their appeal, whether they are being represented by the best known planning consultants should have no relevance. If what they have done is completely outside their grant of permission and you can make an observation stating that what they have done there is a possibility they can be forced to take it down. without knowing the exact details of the permission and what they have done it's hard to give proper advice. If you'd like to give us some more info perhaps i could give you more advice (do you have the planning ref no?).

    Planning ref is 3571/06. We've sent a form in to the planning enforcement people. But the retention will override that if they get it surely?

    The permission contains a lot of changes indeed. the path available to you or your parents is to submit a complaint to the enforcement section so that they are aware of the unauthorised development and to submit an observation on their retention application. while they may have a good planning consultant you should be able to present your arguments in a good planning manner.

    If you like I could give you a few guys who would prepare a planning observation for you or if want I can give you the name of the company i work for. The difference is some mates can do the same job for less, the company adds a certain gravitas to it.

    [btw i'm not trying to pimp for business or anything, just offering information if it is so desired]

    sorry, missed that in the edit. unfortunately from your point of view, yes the retention application will supersed that should they get it. which its why its important that you make an observation. then you can make an appeal to the bord (an bord pleanala), but if you're a direct neighbour you can make an appeal anyway.

    It would be better in the long run if their permission was refused rather than going to the bord though
