Will This Hold Up in Court?

    Do I Have a Case?

    I am wondering if this case will hold up in Irish court.

    I had a Sony Viao which had problems upon problems from the moment I bough it. I was sent back to the company many times and always came back not quite fixed.
    I got the number of the head of customer service and was working with him to resolve the issue.

    He said he’d send me a new computer, but he had to have the old one back first. Which I was not prepared to do because I needed it for work and a few days without it meant lost revenue, etc.

    We ended up getting into a bit of a tiff over it and some harsh words were exchanged, culminating in this man refusing to honor our deal to replace the computer.

    So, I'm wondering if I have a case to take him to court for damages, lost revenue and a new computer (I really just want to scare him into giving me a new computer, as per the original deal)

    I'm not sure I understand? Is this person saying Sony will not honour their warranty because of an argument between yourself and him?

    If it hasn't worked right from the beginning you are entitled to get a refund, or replacement. If they don't want to provide this even after multiple attempts you can go to court. As for the idea of getting money for lost revenue, I'm not entirely sure if this would be a legitimate part of the claim.

    I'd call them back and quote what you are entitled to under law, try not to get worked up and remain calm/collected because you are stating fact.
