On the Boat from Liverpool

MountainyMan is on a bus from Liverpool to Dublin. The boat docks at Dublin and the passengers an assortment of phobics, the very poor and the chronically disorganised board the bus.

A garda boards with them and asks to see passports.

MountainyMan stands up and 'informs' the whole bus that they don't have to show the garda their passports.

    1 Is he right?
2 What penalty is he now liable to?
3 Presumably he won't show his own passport. Can he now be refused entry to Ireland?

    MM

    1. No
    2. Obstruction of a Garda in the course of his duties.
    3. Yes. He can be refused entry.

Why? Not on the basis of failing to produce a passport anyway. None is needed for travel between Britain and Ireland.

    To the op :
    1. Morally or legally ?

    To Bond:
    2. Is informing people of their rights (correctly or wrongly) obstruction ?
    3. On what grounds, given the common travel area ?

Personally I see the CTA as a defunct concept. Mountainyman will need to prove he is either a UK or IRL citizen in order to avail of the CTA.

Also other persons on the bus may not be UK/IRL citizens and are not allowed to avail of the CTA and must show a passport.

I would still see his actions as obstruction.
