failed driving test - grounds for appeal?

    im VERY pissed off. just after coming back from my driving test in naas where the instructor failed me on progress on the straight. i got 4 grade 2's - nothing else on the sheet. to say im pissed off is an understatement.

    i wasnt even going that slow - id say i was doing about 40 km/h in a 50 km/h zone. the reason for this was that the schools were just coming out (the test was at 3pm) and i wanted to exercise due care. now correct me if im wrong, but i thought there was no minimum speed limit in this country. if i had gone any faster he would have failed me for speeding. you cant win.

    i have the test sheet in front of me, does anyone think i have a case. has anyone ever heard of anyone successfully appeal a test result??

    the appeal wont reverse the decision , it only entitles you to a free retest.

    We all know the term Limit means the max you can drive at, but in terms of the test unless conditions are bad you should be doing 50 in a 50 Zone.

    Did you say to the tester that you were only doing 40 due to school being let out? also did you only do 40 when in close proximity to a school or was that as fast as you went for the whole test?

    I failed my car test years ago due to a few of those marks, amongst other thing.

    No he wouldn't. He couldn't fail you for speeding in a 50 if you were doing 50. I understand where you're coming from with the schools and all but ask any instructor and they'll tell ya that maintaining progress is essential.

    Never heard of it tbh. Forget about Naas, crazy 1 year wait. Apply to Raheny and you'll be sitting it again (in an easier centre) in 6-8 weeks. Get 1 pretest from Dave Lyons (like what I done!) and you'll fly it before the summer's out.

    Hard luck mate.

    Sounds a bit rough. Did he explicitly tell you that's where he considered you to be failing to make adequate progress. I presume that if you don't take your opportunity to turn at a junction when a sufficient gap presents itself this could also be considered failing to make progress.

    As somebody already mentioned, the result of the test will not be overturned you will only be given a free retest.

    You'll probably just have to roll with the punches on this one. My gf failed her car test for checking her blind spot when making a right turn in case a bike was filtering on the outside. The tester told her she didn't need to do it!!! (Now is it just me or does anybody else remember a "now you see me, now you don't" road safety ad where a cager hits a filtering biker?)

    Best advice you could get there OP! That's exactly what I did and I aced my test 6 weeks after applying for it!

    You should definitely do that! ;)

    sorry to hear you failed, dont beat yourself up. no point in appealing im afraid, if anything its too much hassle.

    I got failed for the same thing but then passed 2 weeks later and when I passed the guy said it was close and there was still a few areas I should work on - i had max 4 blue faults and in my defense I wasn't used to the ISM bike(I had been using one bike for the first test but it wasn't available for the second one).

    how did you get uour retest so quick?? im dyin to get it done now. suppose there's no point in appealing, life's a cnut sometimes

    I just got a letter from work and sent it in with the application. When I did the pretest for the second test my instructor told me to make sure the tester could see I was speeding up and then slowing down on a road with speedbumps - we went down it during the test and I didn't get any marks for progress so alls well that ends well. I'm currently waiting for my car test and then i'm finished - no matter what new forms of transport they invent I won't be doing another driving test! :D

    Yeah but i'm sure i'll be able to drive a small one on my B license! Or I can fly around on a provisional for a few years!:rolleyes: :D

    Yeah i'd appeal that. Was it a fairly geeky looking bloke with black hair? I did my test with him. Didn say much to me. Now i did pass without fault basically but he did seem very serious and oh you've gotten get everything right kind of guy. I did the speed limit myself, to be honest I think they prefer if you do it if the road your on is suitable for such speeds. I know it was different in your case so i'd appeal. Bastards aren't they. Did you give him the sympathy speech before hand? "Oh please i really need it for...eh..work yeah work!" - worked with me :D

    I ended up waiting a year for my 'A1' test also. I'm waiting 10 months now for my 'A' license without any word yet.
