2nd hand car buying Q

    Possibly consumer issue/legal Discussion of sorts but more related to Motors as its car related.

    Mr X buys car on finance worth 8k , gets behind payments Debt Collectors come to take car. X sells it to Mrs Y for 6k the going rate, Y gets car taxed and insured and has the logbook with her name on it. Mr X tells debt collector car is sold and is in Ys garden.

    Debt Collector calls to Y to take care, she refuses to hand over car, debt collector says judge court soon etc:

    is the finance and any court issues with Mr X and has nothing to do mrs Y and her car?

    If the car was bought on finance, it was a secured loan. Weh X defaults, the car belongs to the debt company, no matter who owns it now.

    Mrs Y should not have trusted Mr X - she should have done a HPI check on the car. Her bank would probably have done this for free.

    Pretty sure (although IANAL) that Mrs Y now has to sue Mr X for her money.

    I'm pretty sure she has to sue him, maybe if he settled at this stage with the finance company it could be resolved.
