Probate time limit?

    Hi all,

    Quick question... Is there a time limit after a person dies that probate must be taken out on their estate. Someone mentioned that its 2 years in the uk. Wondering if there's one over here.

    Checked the court's site and couldnt find a mention of it, and tried giving them a buzz but they're on an easter break...

    There is no limit laid down in law. It can take more than 2 years for a complicated estate. I have heard of probates taking 5 years plus where things had got uber messy.

    The executor has a year to complete the administration of the estate from date of death before the other beneficiaries are legitimately allowed to start kicking up a fuss...if there's no good reason for the estate not to be wound up within that space of time, beneficiaries might be entitled to interest on their bequests...
