Holiday pay question

    Hey ppls,

    Just a quick question about holidays, iv been with a company for the last few months and in my contract it states that i am allowed 20days a year which is fine and good,
    The other day i applied for 3days off and was told that if i take the days off i wont be getting paid for two of them days as i havent been with the company long enough to earn the days....
    The funny thing is that i have already taken 5 days off last month...which i know i hadnt earned and they paid me for them anyway
    Is this normal in companies not to pay for days if you havent earned them, all im thinking is that once i sign a contract them days are mine to take as i like.
    Is it just tightness on their side not to pay for them days?

    Any help would be great,

    After paying for 5 days last month they might consider themselves as having been generous enough or be worrying about the amount of time that you are taking off so early in the employment.

    You earn 1.68 days per month worked for your (20/12) for you holiday allowance, anything beyond that is the companies good will.

    Also please be adviced that they holidays are NOT for you to "take as you like". The company can assign you holidays as they see fit as long as they give you a suitable notice, take into account your social life and family etc.

    As for not paying for them, lets say you take all your 20 days of holidays and hand in your notice on the 20th and work your 7 day notice after four months. Depending on how their payroll system is set up you could end up with either getting 10+ days for free (the company don't bother to claim it back) or recieve a request to pay it back (which is a pain for the company). Hence for the company it is far easier to only use the days to date then anything else as you have yet to earn said days off.

    You should earn holidays on a pro-rata basis. For instance, if you have twenty days holidays, and have worked from Jan-March (3 months) then you should already entitled to 20*0.25 or 5 days.

    It all depends on when you started really, and holidays can be at your employer's discretion also.
