    Guys,

    Does anyone know who would be the best in the country to deal with a case to do with Emplyment law, contracts and Constructive Dismissal?

    Even if there could be such a thing as the best lawyer (and I don't really think there can in absolute terms) I don't think there would be any consenus on who that is.

    It depends on who you are, the value of the case etc. Most of the big solicitor's firms don't take employees cases, only large employers (or so I am led to believe).

    But I also think, without meaning any disrespect to you or to others, that a constructive dismissals case would not be that complicated. You should contact a solicitor that you trust and that you know are generally competent, and they can instruct a barrister who specialises in employment law if it is appropriate.

    I would urge you to think long and hard before instructing solicitor and particularly barrister on a constructive dismissal claim. Remember to bear two points in mind:

    1. The EAT does not award costs. So your full legal costs will have to come out of any compensation award. (For this reason, most practitioners will not touch these cases on a no fee no foal basis.)

    2. EAT awards tend to be quite small, often in hundreds of euros rather than thousands. Only in the most exceptional cases will awards run into tens of thousands. In any event, awards are restricted to actual monetary loss, ie salary in lost job MINUS salary in any new job you manage to secure.
