Broken sewers?

I have just completed the build of my new house. the problem I have is, there was an old house there with a connection to the main sewer outside. This was running under the footpath as normal. My fear is with all the trucks and deliveries the old earthenware pipe under the path may be broken. At the moment it seems to work. I had a camera put down it and it was recommended to be replaced. If I say to the council, DLRcoco, that the sewer is broken and needs to be replaced, will they do it. My contractor wont pass the boundry line as he doesnt have enough insurance to dig the path. I want to get this done before they dish the path for the new drive.
