Summons

Does anyone know if there is a limit on the amount of time that lapses before you get a court summons?

Nearly a year ago, I made an illegal left turn (by mistake) on a road. The road in question does not allow left turns between 7-10 am. Anyway, I was pulled over, asked for my bike licence, tax and insurance. I produced them, was told to go back the other way, and thought nothing of it. The other day, I received a court summons, and a date is set for my court appearance.:(

gardai have 6 months to get the summons into court to be issued from the date of the offence and then, in theory, unlimited time to serve it on the suspect. for example if you emigrated and came back 20 years later it would still be waiting for you. although this is highly unlikely for a minor road traffic offence it still applies

Talk to a solicitor. It may be possible to get it thrown out, but they're the only guys who can say for sure.

In Cavan there was a great fire / Judge McCarthy was sent to inquire / It would be a shame / If the nuns were to blame / So it had to be caused by a wire.

I got stopped for a similar offence (driving on the M50 on a provisional) .......biker cop stopped me and proceeded to lose the rag... accusing me of this that and the other ....said I was driving without due consideration up the centre line which is true but I WAS using turn signals but he was having none of it and said that this offence constitutes automatic court appearance...i pleaded with him and he said to produce my details which I did........that was more than a year ago and low and behold I get a summons a few weeks before Xmas!!! ...i was freaked and duly turned up for my day in court...didnt bother with a solicitor as it was a hearing....sat there sweatin for 2hrs waitin to be called and it turns out I was one of the last people left and wasnt called..........it turned out that case wasnt even registered in the court so I was told to go home by the judge....?????
I couldnt believe this coz the cop that stopped me was there earlier for other cases...
i spoke with another guard who was in the courtroom and he said that it is at the discretion of the prosecuting guard to summons me again and I should go home and consider myself lucky.......

Anyway the most your looking at is a fine or it will be thrown out instead ..I was surprised at the attitude of the judge on my day...he was very fair and took no bull from the cops either so dont worry about it:)
