Employee Rights - Equal Pay for Equal Work

    Just curious about this

    With regard to equal pay for equal work - If an employee gets paid less than a colleague in the same position with the same qualifications can this be considered be in breech of equal pay for equal work?

    Is this something that can be proved easily and does it stand up legally and worth taking further? This is assuming the employer doesnt agree to bring salary in line with that of the colleague

    This situation has arisin for a good friend in work and just wondering what the story is

    Be interested to hear peoples views etc

    Need more info.

    If someone been in the company as say IT Engineer for 5 years said person should make more then a person with same qualification coming in after him (assuming they had exact same experience before they started in the company).

    There is also the question if they where moved over from another department, do they have more responsability (say opening/closing an area/building), have they on call duties, have they more/higher degrees etc. that can play in.

    both people in question are in the job over 5 years and have the same qualification and their roles carry the same responsibilty and work load

    So they're identical from that point of view

    You can't discriminate on the basis of sex, religion, nationality etc

    But it is perfectly acceptable to pay more or less depending on ability, qualifications, etc even if the role is the same. Is this in the private or public sector?

    unless there is a set pay scale an employer can pay anyone what they want so long as they can back it up.

    was this other person drafted from another company and paid a bit extra to come over?

    does your mate know for definite that their qualifications as the same (remember similar is not the same)

    ther is no direct law refering to equal work equal pay, there is however pay discrimination on grounds of whatever the reason is, using someone else as a benchmark of your pay.

    has your mate brought it to the attention of management yet? and what have they said? how much is the difference?

    Has either worker ever received a pay rise? Some companies offer yearly payrises based on performance. Maybe your friend just didn't reach the standards set by their colleague?

    Exactly as said in the previous post... any decent company will have pay related to performance... so if you work hard and well you will be paid more than a colleague who just does the bare minimum.
