    http://www.theregister.co.uk/2007/01/11/spyware_teacher/

Does anyone else find this absolutley ridiculous?

Firstly, no checks where done on the PC to verify the presence of Spyware, and apparently the fact there was anti-spyware software on the machine was used against her. And she wasn't even on the machine when it happened and half the kids don't even know who the teacher was!

It's plainly obvious what happened was some kids were messing, got some popups or some spyware related crap appear and blamed it on the teacher.

Even if that didn't happen, the fact that it took 2 hours to find her guilty on a charge which could land her 40 years is a bit stupid.

Seriously, any prosecutor would be torn to shreds after saying this: "You have to physically click on it to get to those sites. I think the evidence is overwhelming that she did intend to access those websites."

Firstly, the article is poorly written and only bits and pieces of the story seem to be presented so it's hard to make a definitive call.

Secondly, the computer expert stated that the pornographic images came from a "seemingly innocent" hair styling page. To me that indicates that the woman may be innocent. (Admittedly, he was acting for the defence!)

Thirdly, anyone familiar with multiple popups will know that closing one window often just activates another, even if you are using F4 to close a window, you may not be fast enough to stop the pop-ups. If she began to panic it is entirely concievable that she never thought to turn off the monitor. (I know people who just keep pressing keys in their panic instead of switching off and re-booting :D) She may not have been able to stop the display.

Fourthly, the licence on the school 'nanny' software had expired, can she counter-sue the school or can the school also be found guilty as a result?

Fifthly (?), having juries made up of 'ordinary people' is a great idea but in cases where technology is the issue, juries will quite often believe that the individual in the dock is guilty if they don't fully understand the capabilities of the technology in question.

I'd say she was innocent and it was all an accident but that's just my opinion from a badly written and edited piece.

yikes, whatever about guilt or innocence (and it does sound like she was very hard done by), if I were a teacher, it would make me think twice about using computers in my class.

Show the kids something on the net and risk a 40 year jail sentence or make them write an essay on what they want to be when they grow up?

    Hmm, what to do....

    Which is a total shame.
