Ryanair files legal action against French govt
    03 January 2007 16:48

Ryanair has filed legal action against the French government over what the airline sees as an "unlawful labour decree".

Ryanair is upset at what it claims is an attempt by the French to force foreign airlines to apply French labour laws when they base aircraft in France.

The legal action has been filed with the French Conseil d'état.

Ryanair's head of regulatory affairs and company secretary, Jim Callaghan, said the ruling ''is contrary to European laws on free movement of labour and services and the freedom of establishment and is also contrary to the liberalised air transport market.''

He added that the ruling is designed to discourage foreign airlines from establishing a base of operations in France in order to compete with the high fare monopoly, Air France.

Ryanair has also filed a complaint to the European Commission calling on them to overturn the ruling.

I'm afraid I'm with the French on this one. Ryanair want to base fleets in various European countries and ignore the local labour laws completely. If they continue in their current vane they will end up with everyone on Polish, or whatever is the lowest cost / least rights, contract they can come up with within the EU.

I think they're pushing a little too far.

Not sure what would be the best outcome here.

The French are just being protectionist. And their approach is contrary to the European ideal. The 'race to the bottom' could also be categorised as a rebalancing of resources towards the less well off parts of Europe, leading to a fairer distribution of personal wealth. Not that Ryanair cares a jot about fairness either!

On the other (selfish and protectionist) hand, I'd like to keep Ryanair paying tax in Ireland and generating wealth for the country I live in.

Either way, I'm not on the French side on this one :)

BTW, many in the industry believe Ryanair is still in Ireland because the IAA is so easy to push around. We're considered the Liberia of the aviation world. Some would suggest the race to the bottom in the European aviation world finishes here!
