Leaving Company & Holidays Left Over

    I'm handing in my notice at the end of the week.

    I still have 10 days holidays from last year left over. We can carry them over for the first 3 months of this year.

    Does any one know what the legal standing is on this.

    Can I give a months notice and take 2 weeks holidays? Or can I get paid for the holidays I didnt take?

    It doest matter either way to me just I dont want to get screwed out of 2 weeks pay

    Annual leave and leaving employment

    It is illegal under the Organisation of Working Time Act, 1997 for an employer to pay an allowance in lieu of the minimum statutory holiday entitlement of an employee unless the employment relationship is terminated. In general, your annual leave is calculated on the basis of hours worked.
    If you are leaving a job you are entitled to receive payment for any outstanding annual leave and public holidays due to you.

    It'll be up to your employer ultimately. They most likely will pay you your holiday money when you leave, but depending on the industry, and your role, they may also let you take the days as part of the notice period.

    As I said I dont care if I have to work 4 weeks or 2 weeks notice as long as I get paid the holiday money that would be owed to me I'm happy
