Passenger in car drinking

    Was reading through this:

    and was wondering if anyone here has an answer. Cant seem to find any specific legislation on it, cant see the reason why it would be illegal (dont see the difference between a back seat passenger and a limo that has no partition).

    For anyone who doesnt want to read, is it an offence to be drinking alcohol while in a car, provided your not the driver?

    (The question could also be asked is it illegal if you are the driver - provided your not over the limit - but you could always be done there for driving without due care and attention anyway)

    there is nothing wrong with drinking while a passnger in a car apart from the fact that it would be bringing undue attention to the driver of the car.

    wrt the drunk in charge, its a very grey area (like all drunk driving legislation) i cant rememeber if you are ok if the keys are in the ignition but you are in the back seat, you wouldn't be ok if you were in the front seat with the keys in your pocket (all of these presume that you are on your own in the car at the time).
