    The mandatory 10 year provision came into force on the 26 May 1999 http://www.irishstatutebook.ie/ZZSI154Y1999.html.
    It provides that if the drugs in question are more then £10,000 worth and are possessed with the intent to supply http://www.irishstatutebook.ie/ZZA10Y1999S4.html the penalty is set at 10 years http://www.irishstatutebook.ie/ZZA10Y1999S5.html

    Section 27(3)(c) however provides that if there are exceptional and specific circumstances the mandatory 10 years need not be imposed. Factors such as whether a guilty plea was entered in determining this.

    According to recent media reports judges have been using this provision greatly.

    Statute of limitations only applies to summary offences (where the penalty is less then a year in prison and the case is heard by a district judge sitting alone). In such a case the summons must be issued within 6 months.

    Possession with intent to supply is however an indictable offence. It must be heard by a judge and jury in the circuit court. There is no limitation period for indictable offences.

    What do you think would be the best case scenario for this guy if he pleads guilty? And is a jury necessary if he does so? He was conned on to the situation in the first place remember but does admit his part?

    Not to harp on about this all the time but "that guy" should go to a solicitor rather than put the question to the masses for comment.

    If you're feeling sick & dizzy all the time do you:

    (a) go to see your doctor; or
    (b) put an ad in the paper: "sick person seeks advice; no time-wasters" etc.


    It is seriously irresponsible for anyone to be advising "this guy" here in connection with criminal charges.
