Advanced odd chip ruling.

Location: Home game, dealer's choice cash game. In this format we play there are no blinds, just an ante from the dealer only, for choosing his/her game.

Rules state: In a high/low pot a leftover chip goes to the winner of the high pot.

Situation: The rules are written this way, assuming one winner for high and one winner for low. Now here's a pot with one player winning the high and two other players splitting the low as they each have the same (best) low hand. The pot splits in two evenly, but the low portion of the pot does not. For argument sake: the pot is 130 chips, so 65 for high and 32 for each low and 1 leftover chip.

Question 1: With the current ruling, or should I say ruling omission, who gets the odd chip and why? (options are: dealer (b/c of ante), high, first low after the button or both lows (so 64 for high))

Question 2: How should the rule be re-written, using the most fair system?

If there is an odd chip due to a split pot it should be given to the person nearest to the left of the dealer. Under your rules, the usual beneficiary is irrelevant since he did not earn any of the low pot.

The high must get his half of the pot, since it splits evenly he takes his portion and is dealt with. The dealer should get squat, presuming he's not in the hand. The chip should be split between the low players and so can only go to one of two of them. So I'd rule it went to the low-hand winner nearest the dealer.
