    Terms & Conditions
    These terms and conditions (the "Agreement") are a legal agreement between you ("You"), and us, Reporo Limited (Company No. 4394624; VAT No. 796128295) ("us" or "Reporo") whose registered office is at Europoint, 5-11 Lavington Street, London SE1 0NZ, United Kingdom. By using the Service (defined below), you are deemed to have accepted these conditions so please read them carefully.

    1. PROVISION OF SERVICE
    1.1 The Reporo service and any and all support that relates to it (the "Service") shall be as described on our web site (currently at www.reporo.com) (the "Website") from time to time though we reserve the right to make changes to the Service as described on the Website. You must keep your account details up to date / accurate and notify us of any changes as described on the Website.

    1.2 In consideration of your use of the Reporo Service and the licence of the Software which allows you to access the Reporo Service You agree to abide by these terms and conditions.

    1.3 "Shop on your Mobile" Please note that in providing the "Shop on your Mobile" part of the Service to you, we are acting only as intermediaries in connecting you to the retailers in question and have no responsibility for products or services purchased from or supplied by the retailers with whom we operate. Use of the Service will be subject at all times to Your acceptance of the terms and conditions of each and every retailer from whom You purchase before placing an order using the Service. Where you have not signed up to the Service via the relevant retailer sites, we will try where we can to provide You with links to these conditions or direct You to the Retailer's website.

    1.4 "Reporo Messaging". This part of the Service relates to the sending of texts messages, picture messages and instant messages to/from You and other Service users. You understand and agree that the Service may include advertisements subject to the terms of the Reporo Privacy Policy (available on the Website) and that these advertisements or other related information are necessary for us to provide the Service. You understand that when the RService is not active on Your mobile phone that we will notify You by ringing your phone twice known as a "dropped call". By default we will only alert You between the hours of 8am and 10pm GMT. If you wish to change these times then You can edit Your account settings on the Website.

    2. CHARGING
    2.1 The Service is provided to You free of any charges from us. However, You are wholly responsible for all operational / network costs of accessing and using the Service which includes receiving and sending messages and the cost of all products and services purchased (plus VAT and other taxes/charges). The cost of products will be the amount displayed on Your phone and will be inclusive of any applicable VAT and Retailer's service charges unless stated otherwise.

    3. OFFERS
    3.1 In shops which contain "Special Offer" sections, any promoted offers and discounts are available only on those items within that section.

    4. SOFTWARE LICENCE
    4.1 By registering for the Service, You are permitting Reporo to download the then current version of Reporo's software (the "Software") to Your phone. Reporo grants to You a personal, non-exclusive, royalty-free revocable licence to use the Software on Your Mobile Phone for the duration of the Service and for the purposes only of accessing the Service. So that we can maintain the integrity of Your account, this licence covers only You and no other person may install, use or copy the Software. However, anyone may register to use the Service at the Website and we would encourage You to direct others to it. Other security restrictions and obligations from time to time are as described on the Website.

    4.2 You may not alter, loan, sub-license or otherwise transfer the Software to anyone else and except insofar as permitted to do so by law, You may not reverse engineer, decompile or in any way decode the Software. The Software constitutes valuable confidential information of Reporo and no ownership rights are transferred under these terms.

    5. ACCOUNT DETAILS AND SECURITY
    You must keep secure all usernames/ passwords provided to You and ensure the Service is only used by You. You are entirely responsible for all activities that occur in accessing and using the Service using Your usernames/ passwords. You shall immediately notify us of any unauthorised use or any other breach of security but to avoid any doubt, we are not liable to You or anyone else for any loss or damage arising from Your failure to comply with the above provisions or any other unauthorised use. You must ensure that the download / use of the Software and use of the Service is permitted under Your operator's network terms and conditions and we shall have no responsibility or liability in this regard.

    6. TERMINATION
    6.1 You may terminate the Service at any time by closing Your account by contacting us through our website. We may terminate Your use of the Service immediately at any time without notice if You breach any of these terms or if you have not used the Service for a period of 6 months or more.

    6.2 Termination of the Service shall not affect the accrued rights and liabilities of the parties or any obligations which are intended to survive termination. (including but not limited to Clauses 3, 2, 4, 7 and 8 which shall survive termination of this Agreement and shall remain in full force and effect. We shall delete Your personal information from our systems within 60 days of termination of this Agreement.

    7. DATA PROTECTION AND PRIVACY
    By registering for the Service, You consent to our retention, use and disclosure of Your details (including payment information) in the UK and any other country in which Reporo or its agents operate (i) to execute the Reporo Messaging part of the Service by enabling you to receive messages from other users of the Service (ii) to retailers and payment service providers, if You choose to use the the "Shop on your Mobile" Service and (iii) to our use of Your information to contact You, including via Your phone and by email, to notify You of updates of the Software and the Service. Please see the privacy policy on the Website for further details.

    8. LIMITATIONS/AVAILABILITY OF SERVICE
    The Service is subject to any limitations from time to time stated on our Website including but not limited to incompatibility with certain models of mobile phone and lack of GPRS coverage in relation to certain network providers, for which we shall have no responsibility. Whilst we do what we reasonably can to ensure availability at all times, we cannot and do not offer a continuous, uninterrupted or error free service and no warranty is given in this respect. Without limitation, we may at any time temporarily suspend/restrict access for back up, maintenance, repairs and improvements and/or give instructions to You regarding the use of the Service which we believe are necessary for security or to maintain or improve the quality of the Service to You and to other customers. You will comply with such instructions and, while they are in force, such instructions will be deemed to form part of this Agreement.

    9. LIABILITY
    9.1 Except as expressly provided herein, the Service and Software are provided "as is" without warranty and we do not make any representations or warranties whether express or implied (by statute or otherwise) relating to the performance, quality, security or fitness for a particular purpose of the Service or the Software or any aspect of it or otherwise and all such representations and warranties are hereby specifically disclaimed and excluded. Without prejudice to the generality of the foregoing, You acknowledge that certain aspects of the Service are dependent upon third parties, including but not limited to other Service users, retailers and third party payment service providers and telecommunications providers and we cannot accept any responsibility or liability for their failings including without being limited to any failure to deliver or supply the goods or services. For the avoidance of doubt, we shall not be held liable (except where we have been grossly negligent) for any loss caused by failure to receive a message or incorrect processing of details for a purchase transaction, whether this is caused by a technical failure in our systems or by a failure of third party systems.

    9.2 Whilst we do what we reasonably can to ensure that all third party information information including retailers and other Service users is current and accurate, this is not in our control and we therefore give no assurances and shall have no liability for any such information.

    9.3 Without prejudice to the foregoing generality, we exclude our liability to the maximum extent permitted by law whether under contract, delict, tort (including negligence) or otherwise and in no circumstances (other than when we have been grossly negligent) shall we be liable for indirect or consequential loss or damage of any nature. Nothing in these terms is intended to limit or exclude our liability where we are not permitted to do so in terms of local law. For the avoidance of doubt, we shall not be held liable (except where we have been grossly negligent) for any loss of or disruption to any other application or service stored on your mobile phone due to it being incompatible with the Service.

    9.4 Notwithstanding the above, if we should be found liable for any reason, such liability shall (insofar as it may be limited by law) not exceed the total cost of the products or services purchased using the relevant aspect of the Service which is the subject of the claim.

    10. GENERAL
    10.1 This Agreement constitutes the entire agreement between You and us relating to the use of the Service and the Software and supersedes all other agreements or understandings between us and You. We shall have the right to revise the terms of this Agreement at any time, but shall use our reasonable endeavours to give You notice of significant changes. We will not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control. Notices to be given by us under this Agreement may be given by email or otherwise at our discretion. Notices by You must be given as set out in the Service description from time to time on the Website.

    10.2 This Agreement is governed by the Laws of England and Wales and by accepting these terms, You hereby submit to the exclusive jurisdiction of the English Courts.

    YOUR ATTENTION IS DRAWN PARTICULARLY TO CLAUSE 6 WHICH DEALS WITH HOW WE USE INFORMATION YOU GIVE US AND CLAUSE 8 WHICH CONTAINS IMPORTANT INFORMATION ABOUT OUR LIABILITY TO YOU.     Seems like you text from within a downloaded Java applet, while paying your network to be connected to the interweb. It's supposed to be much cheaper but I guess depends on your connection charges.

    Not sure I could be bothered texting within an applet anyway. On my phone (V3) that would probably take an age - and texts are a pain as it is anyway.

    For a big texter with plenty of time (aka a student!) it might be worth it.

    is there not a minimum gprs connection charge with vodafone that would erode any savings. I am open to correction.

    muppetkiller: Is there something in those terms you'd like to warn us about? DOLLOPING the entire terms here without pointing out anything of concern or interest is useless.
    Seems like you text from within a downloaded Java applet, while paying your network to be connected to the interweb. It's supposed to be much cheaper but I guess depends on your connection charges.
    I think someone has a link to an applet in the Mobile forum that works with all the Irish sites from your phone so you can send a txt for a quarter of a cent. So you wouldn't be using a 3rd party and get to use your own number.
