Charge backs on ebay... may have to do one

    Following from my been pissed about on ebay thread the phones finally arrived however they are branded to Orange (not mentioned in the auction and the picture of the phones shows no branding) and one of the phones is faulty (battery is stuck - Google search shows it's a common menufacturers problem).

    I've emailed him 4 times since with no response.

    His auction states:

    All our products come with a 14 day money back guarantee. We are a UK, VAT registered company with experienced and fully trained staff ready to answer any questions via email

    Therefore I'm going to email him tomorrow saying I'm returning the 2 phones back to him. However I'm asking him for a full refund, including all postage because 1 phone is faulty and the other phone cause it's badged to Orange.

    He may refuse or worse ignore my emails (like he has done to date). Therefore I'll post them back registered but I just wanted to know, if worse comes to worse and I've sent the phones back and he issues no refund whats the story with charging back the origional paypal payment which was on my credit card?

    Open a dispute with paypal and chargeback the money. You only have 45 days from the date of payment to do this. He will probably try to stall you so it goes over the 45 day limit and then you will have no recourse.

    Go straight to a claim with Paypal too, don't wait for the seller to respond to your dispute as you've already tried contacting him without answer. Don't send the phones back yet either until he responds.

    If he doesn't respond to the claim within 15 days then Paypal will find in your favour and return your money.

    I've done this twice now, one seller didn't respond and the second one did. You may have a battle on your hands to get the cost of returning the phones refunded as most eBay sales will exclude this from any guarantee. I had to pay the cost of registered return post on my item (was €9 out of the €70 it had cost me).

    I've made the claim with Paypal (actually I started a dispute and the seller escated it to a claim which was weird). Anyway he resonded 5 mins after I made the dispute (suprise surprise). His comment was to send back the phones "unused" for a full refund. What a tit. I'm returning one of them because the battery cover is jammed on the back. So how can I return it unused?

    Anyway the fault is logged under the transcript on paypal. I've boxed the 2 phones up (taking digital pictures in case of any further disputes from him).

    Paypal have said that I have to pay postage back but I'm hoping they will make him refund postage that I initially paid as the items were not as described and one was faulty.

    There is an endless amout of shítheads on eBay. Why can't sellers just be fair and straight?

    I think you're chances of getting the return postage back are about nil. Paypal only cover you for the cost of the goods themselves.
