Quick Question ebay seller

    Iv seen a set of tyres on ebay for buy it now, i proceded to do so and won. Now i then asked the seller if they could find out the total cost of postage (as i didnt know their address,and they would know the weight and demensions). The original ad said collection only. So i get an email saying the seller has asked to mutually withdraw from the auction. Followed by a mail saying "said i wasnt going to post,mutually withdraw so i can get my fees back" So i said " no, ill get someone to collect them,how would u like to pay. Paypal or bankers draft ok with you?"
    "you have not said you was picking them up thanks a lot now i have to piss about trying to get my selling fees back cos your not getting um"
    Then i get a user id address email with both our address followed by another one saying "im taking you to the small claims courts!". What a load of crap. Can he really do that? I admit,i know he said he wouldnt post,but i explained my reasons for asking him to post. then i agreed i would get someone to collect them asap. What can happen from here on in?

    Well in fairness you should have read the auction in the first place regarding posting of the item. I guess hes pissed off about it and won't sell them to you now because of your initial stance (first asking about postage and then trying to pull out of it) on the matter. He will probably lodge a complaint with eBay but I don't know how far a small claims court thing would go.

    sure if u sed u will get sum1 to collect them, then that is agreeing to the original terms of the auction so he cannot do anything (imo) he is just pissed off coz u decided to chance it and ask if he wud deliver them

    No no, i never said i was backing out of the purchase. In all my emails i have pleaded that i still want to buy them. What annoys me is he says he wont let me have them after 1 email and 12hrs since the auction ended. Its like im dealing with a twelve year old. I got a mail this morning saying i owe him 125 in court costs,7£ ebay fees and 150£ for the wheels (which im not going to get,its just to cover his "hassle") This just reeks of a scam.

    true. u cud walk away and if it is a scam then he will too, if it isnt then he cant bring u to court because u agreed to his conditions of the auction.

    Personally I would tell him to STFU and walk away. Are you 2 in the same country? If not he won't be able to take you to court.

    he is in englnd and im in ireland. I wont post a link just yet as he has just relisted the item this time " desperate to sell at 99£" which is 50 less than the buy it now last time. i keep offering to cont ahead with the deal and abide (?) by the rules of ebay. I suppose ill just have to let it go. Hes stoped replyign to my emails too.
