I am making a forum system in PHP and its all working perfectly so far, I am adding custom BBcode and using emoticons. I like the PHPBB emoticons but am I allowed to use these in my script or do I have to request permission from PHPBB

If you are planning a successful site it's safer to abide by copyright law.

Have a google, here's one example of free icons available under the creative commons attribution license - that means on your site you must have a link back to the authors site. I'd say a link on a credits or about page would do the trick.
