A question about Notice period

    Hi all,

    I handed in my notice as my employer is changing the role of Tech. Support to a more sales oriented position. (At which I am not very good, and I hate trying to sell...)

    We have a 6 week notice period, but the problem is that once we have handed in our notice, the company policy is to refuse any further holiday requests. I have about 60 hours in lieu, but cannot take any time off work to look for another job.

    I've checked the Oasis site but can't seem to find anything about this. It's a right pain in the *** as I am trying to find another job...

    Anyone know if this is legit? I can't imagine it is...

    it was mentioned in a thread below this that the max notice period is 4 weeks by law but nobody got a link to confirm it.

    Well I know its a **** but at least you'll have 60 hours of pay there to get when you leave if you cant get a workaround but that wont help you finding a job.

    The minimum in law is one week. Company "policy" counts for nothing unless you signed a contract. Talk to your union rep or the Labour Court. Time off in lieu is not holidays - that is, not statutory annual leave.

    Sorry, I was unclear, I have about 50 hours annual leave accrued, the rest is time in lieu.

    Its perfectly legal for your employer to decide when you can and can't take holidays. They are well within their rights to refuse you taking your holidays before you finish up, in fact its quite common. They just have to ensure that you get paid for any outstanding holidays when you leave.

    Your employer is a gobshiite then, know exactly how you feel, many techs don't make good sales people (or would ever want to be good sales people - myself included).

    Hope it all works out for the best and fair play for being true to your principles - nothing worse than trying to be something you're not and utterly hating waking up in the morning!

    If they won't give you the hours off your entitled too,make sure you get paid for them before you leave.
