registered business names in Ireland

    Can two people have the same business name in Ireland? Not a Limited company now... just the business name. Thanks in advance.

    I think (from my Junior Cert Business days) that you're allowed to label your shop with your own name e.g. Murphy's etc. So if there are lots of Murphys setting up shops then yes, you can have the same business name.

    Just don't try to set up a Micrasoft company ;)

    Yes of course you can have several businesses with the same name. You will still have to register it at the CRO as a business name.

    Appears to be nothing against it in the Registration of Business Names Act

    I know two companies can't have the same name however. Beaware of the tort of passing off however, if you take the same business name of an established person in the same line of business as you, they can sue for you trading on their good will.

    McDonald's Inc -v- McDonald Chipshop failed though. McDonald had more right to the name McDonald than McDonald's Inc.
