Sick Certs

    Just wondering if anyone could tell me the procedure behind a sick cert. What I mean is if a person gets fired for being taking days off, even though they have a sick cert, does this person have the right to take legal action?

    I would have thought its unfair dismisal with or without a cert, as long as you rang in sick as that is classed as having quit yourself if not. Once youre there more than 366 day and not part time you can take legal action.

    Were you a contractor?
    How long were you working there?
    How many sick days? How many days are you entitled to take (As per employee handbook and/or contract)?

    Being honest, this was about a friend of mine. She's just getting a bit of stick where she is working.. and she was extremely sick there, and I just thought I'd check out the procedure for her just in case.

    She's part-time and have only been working there about a month or so now. There probably isn't any sort of procedure, but thought I'd ask anyways. Thanks though.

    not advise , but some general information...

    if one was only working there a few months that could be a problem , most protections don't kick in until 12 months (except Trade union stuff,pregnancy related stuff , Minimum wage disputes, Adoptive Leave or the right to carer's leave under the Carer’s Leave Act, 2001.)

    The employer is not obliged to accept a sick certificate. He is perfectly entitled to request that an employee see a Doctor of his (the employer's ) choice
