Gardai Confiscation of Vehicles - Legal?

    What are the legal grounds for the Gardai confiscating a vehicle? Our locals have issued a proclamation stating that, should a motorist not remove an item (e.g. large exhaust etc… ) from their vehicle within 14 days , the Garda will confiscate the vehicle.

    Section 41 RTA (No tax or insurance) and Section 140 Finance (not registered) are the most common powers to seize vehicles.

    Oh and we can seize vehicles to test them which is what I presume the intention is.

    I'd love to see you seize my bike to "test" it :mad: , I'd make it worth your while if you know what I mean.


    My mate was stopped with his R6 and 2 Gardai said that the pipe wasn't legal (it was stock) and that they have to test. One of them proceeded to drive the bike down the road in first gear and blew up the crank casing.

    Not a threat and I'm definitly not coming onto you (you only wish ;) ). So are you trying to tell me that you have mechanical training to enable you to diagnose a vehicle after driving it for 5 miles. I really find it hard to believe !!!.

    What I was saying is that I have witnessed Gardai "test" a vehicle and detroying it. I don't see how you can be possibly qualified to do this.

    if the vehicle has passed its NCT test the exhaust is road legal as it stands at the moment. in england once the exhaust box is E marked it is deemed to be road legal.

    Incorrect.

    Changing your exhaust anyway from the manufacturers standard is an offence under the road traffic act. It may well pass the NCT but you can still be prosecuted for it in the district court.

    Its really only boy racers who tend to be prosecuted along with a host of other summonses as they are the biggest offenders when it comes to the road traffic act.

    Im talking L plates, number plates, sun visors, incorrectly fixed bucket seats, Over sized alloys (wheels not turning full lock), exhausts, inessential stickers (tints), unaccompanied, tax and insurance offences, tone horns or sirens, wrong colured lights emmitted from front or rear (neons) blah blah blah..
