witholding my p45

    hi all

    im looking for some1 that knows about employer/employee issues.

    my ex employer is witholding my p45.
    i gave them a months notice in april i have since left adn started a new job, (which im 2 weeks into)
    its been 6weeks since the company knew i was leaving

    the hr manager told me it was in the post last monday and i still ahvent received it
    im wondering can i send her an email staing that it is against the law to withold my p45 and reference letter?

    any help would be appreciated!

    as soon as you left, your p45 should have been sent out to you within a week.
    Have you no contact within the wages dept that you can call?
    HR Managers are a waste of space

    She doesn't have to give you a reference letter but she does have to send you your P45 promptly. Tell her that you need your P45 immediately and if seems that they are stalling again ring the local tax office and tell them that they are not giving you a P45. Typically doing that will result in you getting a P45 very quickly.

    the same thing happened to me. they kept giving me the same excuses (in the post etc) the only thing i can recommend is that you ring them every day till you get it(it worked for me)they will soon get fed up of it and will send it to you. best of luck

    Ring the tax office! Report them for withholding your P45 and believe me you won't be long waiting for it them, happened to me a few years ago.

    employers must return ur p45 as soon as possible but if u were paid monthly they may be keepig until ur last pay check. by law all companies are required to give u a minimal reference which states so-and-so started on this date as a operator/manager/loo roll replacer and finished on this date. they cannot give u a bad reference.
