Arrest warrant

    Do the Gardai have the power to enter a private house to arrest a person on foot of a warrant? Say if who answers the door says the person is not home can the Garadi say we don't believe you and enter?

    Also Is the onus on the Gardai to establish the identity of the person they are after. Say the warrant was for a John Smith and the guy says he is Harry Smith and produces proof can they still arrest?

    If they have a warrant they dont have to knock at the door.

    They can take it off its hinges and rush in.


    So yeah if somebody says the person is not at home they can push past.

    As Chief--- says they can perform a forced entry if they feel it is necessary to arrest a suspect. Hava a look here on oasis.gov.ie for more information about arrests.

    The state would be liable to pay for a new door aswell.
