Graffiti in chalk is it illegal?

    IHi ,

    I want to make a protest about something and want to do it in chalk to grab the attention of people when I am not there. I was thinking of using chalk as it is not permenant to make an illistration of the problem. I was just wondering is it illegal?

    I dont think it is criminal damage, but it is defacement all the same.

    There probably is no criminal sanction on it, but dont hold me to it!

    Well if you deface someones property its criminal damage, it doesnt have to be permanent as it still damages the appearance and requires cleaning. Graffitit whith chalk is no different to that with paint but possible it may get a lighter sentence.

    I want to draw on the ground so it is public property. I have to be caught is another thing. Considering what I am going to do the police would be in a lot of trouble as I would be pointing out the law anyway. So to cahrage a person for apeacful non destructive protest about illigal action would be a push and probably not worth the publicity.

    Is writing something on the ground in a transient substance criminal damage? What about children playing hopscotch? It might be, but has anyone any knowledge of of how this provision was interpreted?

    It *might* also fall under the litter pollution act if chalk can be considered as litter:
    "litter" means a substance or object, whether or not intended as waste (other than waste within the meaning of the Waste Management Act, 1996, which is properly consigned for disposal) that, when deposited in a place other than a litter receptacle or other place lawfully designated for the deposit, is or is likely to become unsightly, deleterious, nauseous or unsanitary, whether by itself or with any other such substance or object, and regardless of its size or volume or the extent of the deposit;

    I hate to have to draw your attention to this MorningStar (yes I'm back from the banning you gave me), but you have effectively advertised on a public bulletin board what your intentions are. Look at the who's online php on boards vbulletin, and you'll notice a number of spiders. They review the boards constantly and process plenty of information.

    In addition, if the gardaí were nose-out-of-joint about what you do, they could apply for a disclosure order, and force boards.ie to tell them your ISP and IP address.

    No one is allowed to condone illegal behaviour - my advice to you is to do something constructive about the issue instead of causing yourself problems like this.

    I mean, to what extent do you view it as a good idea to upset the people who enforce law and order? I would carefully reconsider all of this if I were you.

    I'm pretty sure you could be done for something along the lines of anti-social behaviour? You could throw a milkshake at a shop window, would still be easy to clean up etc, but definately an offence. Something against the public order act anyway...

    Couldn't you think of a constructive method of protest?

    I have tried other methods and wish to know if I would be breaking the law by using chalk. Nobody here seems to be able to answer for sure.

    lol, and to think i was going to be the first to reply to this thread but then saw who the OP was.

    People have answered your question as best they can relating to the waste management act or it being criminal damage. But knowing you, you'd only trust an answer from a supreme court judge, and even then you'd still want to contest it in the European court.

    Yes it in itself is not illegal and is accepted if you are doing it for the right reason. Very unlikely you would be charged if caught doing it.

    As for your protest, listen, its a crime, simple as. You want to protest then protest but within the law.     Protest wont last very long if it rains which in Ireland the probability is pretty high, might even rain before the guards get there, I would however be of the opinion doing anything to someones else property without consent is illegal.
