driving offences - mandatory penalities ?

    Are these being enforced across the board or is it just that Lady Judge down Carlow way ?
    Penalties on conviction for dangerous driving causing death are the same as penalties for manslaughter and in addition, carry a mandatory disqualification from driving for a minimum of five years. All convictions for drink driving carry mandatory disqualifications from driving.

    * Mandatory disqualification periods of 1 year or more may be subsequently be halved by the courts.

    Careless driving: This is defined as 'driving a vehicle in a public place without due care and attention'. The Gardai enforce careless driving offences and this involves a mandatory court appearance. From 4th June 2004, a driver charged and subsequently found guilty of careless driving will receive 5 penalty points on their licence. Drivers may also be fined up to a maximum of 1,500 euro, or given a prison sentence to a maximum of 3 months. (You should note, the courts also have discretion to impose both the 1,500 euro fine and the 3 month prison sentence together).

    Where a court disqualifies a person on conviction for one of these offences, it must order an extended retest. The courts also have discretion to order a retest for any other offence which carries penalty points: an extended retest where disqualification is obligatory, and an ordinary test where disqualification is not obligatory.

    Can our courts force someone to do a retest after their period of disqualification was up ?
    Could the person legally drive then before the retest ?
    How would this apply to those on provisionals ?
    What would be the point seeing as up to 1/7th of our population has a driving licence without having passed the relevant test ?
