Quick Legal Advice?

    I am sorry lads for posting in here, but I need a question answered cause my mate is in turmoil.

    He signed a contract this evening to work in Dubai teaching, yet he doesnt want to go. He was egged on by another mate.


    He is now super worried that if he doesnt want to go , he will be in massive trouble if he breaks the contract at such an early stage.

    Please help.

    Ok more info being is that he starts on 1st September but he signed the contract today. The part of the contract that is worrying him is this part:


    If a teacher signs his contract and then in breach of contract fails to arrive in the UAE or to carry out his duties there or leaves the school before the end of the year (s)he will be liable to compensate the school in respect of loss incurred by it as a result of termination of the contract by the teacher a minimum of half a month’s salary remuneration in respect of each month of the remaining period of the contract.

    Tell him to get onto them as soon as he can. If he's not going to go they're going to have to be told sometime, and there is less to compensate them for the sooner it is. I'd say if he just signed the contract recently there shouldn't be any liability.

    Sounds like he might be young enough, if he's just out of college he could try the Free Legal Advice Centre (FLAC)

    I'd also advise putting this up in the legal discussion forum, I'm in no way legally qualified so all this is just opinion.

    If he rings now and terminates he'll be ok, it gives them 5 months to source someone new. Chances are if he didn't show up and didn't say anything to them then they wouldn't persue him, had he signed a contract to purchase a house out there, then he might be in a bit more trouble.

    Other than that, buy a dress :rolleyes:

    not a legal eagle but don't all contracts have a cooling off period. I wouldn't be too bother being honest. just get in touch and say something came up. Give them plenty of notice and they should be ok. Sounds like a bit of a silly contract being honest that line you quoted. I'd probably mot have signed it.

    Also, how EXACTLY would they try and get the money from him? Keep him captive in UAE? Unlikely!

    He needs to inform them NOW by registered letter. They can't realistically claim damages of 1 day....but if he leaves it 3 or 4 months!!

    My advice - do it now!

    Ring them up and tell them that you've been diagnosed with some serious disease, like cancer, and they'll probably let you go no problem!

    The contract is unforceable. Your friend should write to them as a courtesy and ONLY as a courtesy and tell them he has changed his mind.

    If they give him shot he can sue.

    Maybe he could just go and do it? Wheres the harm? It would be a huge experience. I think he may be just freaking out for nothing. Also, is this your friend actually you??

    i want that understood. the advice you get here is not the advice of anyone that understands the legal standpoint, and simply advice.
    if any of the advice here is followed and something bad happens, then neither the users or the site will be held responsible.


    ok....

    read the contract again. there should be a clause in there that allows either party to cancel within a certain amount of time. its usually three months with a weeks notice on either side.
    i would suggest that your friend contact the HR department and tell them that he no longer wants the position.
    it may be that they have no problem withthat, will be annoyed and will never get a job with that company again.

    make the call asap, put it in writing as well and fax, and keep the fax receipt.

    if it goes beyond a sharp word, then you will need to get proper legal advice, but make contact now.
