Harassment in the workplace

    First things first.
    I'm not a homophobe.....
    BUT......

    Some guy squeezed my ass in work last week.
    I decked him.

    I'm almost certain I'm gonna lose my job as hr are pressing for assault.

    If this had been a woman, and I had been the offender and she punched me, would she be in my current state?


    No...she'd be suing for harassment, thats what she'd be doin.

    What do ye think I should do?

    If HR try to do anything about it, threaten to sue for sexual assault.

    Actually, screw that, you probably should just sue anyway. Make a few bucks for yourself, and highlight the plight of the male worker in these situations.

    Maybe in a overly homosexual sport like rugby its ok in the showers, but its definitely not ok in the workplace. Tell HR the guys actions were totally inappropriate and should be dealt with, sure you over-reacted but so might anyone in your case.

    TBH I think the OP probably has no come back. Not really any reason for violence in the workplace. If you had used proper procedure and channels you may have had a case against the pincher but tbh I reckon you're goosed now.

    They'll probably see what he was doing as not as bad as what you did. i.e. make love not war. :D

    What's your definition of a homophobe ?
    You're either a homophobe and/or have anger management issues.

    Under the Irish labour laws, a company has to provide its employees with safe co-workers, otherwise they're legally liable. You decked a guy....
    If you happened to do that again, then the company are wide open to being sued for an unsafe working environment/co-workers.
    The directors themselves could be hauled up in court in such a case.
    It's 99% likely that you're fired, and HR are just building up the evidence and paperwork to cover themselves.

    Not sure what you expect out of this situation ?

    Decking the guy is not a proportional response to what he did, whether it was serious or messing cos he knew how wound up you'd be.

    Sexual harrassment of women is more serious because they're more physically threatened by it...

    If you're hard to replace at work, you might survive.

    You did the right thing, if it were me I would have made sure he did'nt get up, sue the c*nts, as a matter of fact to a degree it could be classed as sexual assault and you were defending yourself.

    Woody, this is not an equality issue.
    Women are vulnerable to sexual attack, and certain types of sexual harassment in the workplace could be perceived as a prelude to an attack outside of working hours. I seriously doubt that the original poster thought he was in any physical danger...... he freaked out because he couldn't handle the situation like a proper adult, with a certain amount of emotion control.

    Violence and aggression are not acceptable in the workplace.

    If "Johnboybob" was able to deck your man, then he was well able to take care of himself.

    I see you're exercising your equal right to be as hysterical and over-dramatic about a minor incident as a woman.
    And it was just a minor incident which could've been easily dealt with.

    Are you some kind of advanced level of amoeba? You do NOT go around punching people in the workplace - no matter what. If you feel "sexually harassed" you go to HR/management and do something about it. You do not punch people.

    I think you seem to have issues here which are clouding your point of view. It has nothing to do with someone being a "degenerate of dubious sexuality", and the fact that you are crying "equality" in the same breath is jaw-dropping in it's stupidity.

    If the company has any kind of decent HR policy, sexual harassment is sexual harassment, no matter who is involved. The same goes for policies about violence in the workplace. So I don't believe there is a bias here, more a percieved one on your part.

    If that gay guy has done this before, and it has been brought to the attention of HR, then that could well be his 2nd of 3 "strikes".
    To fire someone you normally need to give them something like 2 written warnings, then you can let them go.
    "Gross misconduct", like punching is grounds for instant dismissal.

    Best you can hope for is "to bring that guy down with you"... get him fired too.

    The punching is a no-no, except in self defense. So he slapped your ass, you could have just reported it. Before you do get sacked for it, write a letter of complant to HR about getting your ass fondeled by a male work colleague. Don't mention that you know that they're making a case agasint you. Do mention that although you're sorry for your actions, you feel that you have the right to work without having to worry about getting sexually assaulted.

    Contact your solicitor, arranange a meeting with HR, this guy & his solicitor if he wants & you with yours.

    Basicly push for an agreements that you wont sue both the company and this man if they drop the charges, but i cant see you not losing your job over this...but at least try to save your own skin before you go...

    By the way decking someone in work is far worse than touching someones ass...regardless of taking the piss or in a gay advance....
